(A) The operation of SWFs shall not interfere with public safety communications.
(B) In the event where necessary for the construction of public improvements, wireless equipment shall be relocated at no cost to the town in order to accommodate a public project.
(C) A wireless provider shall be required to repair all damage to the town's property and the right-of-way that is caused by the activities of the wireless provider or the wireless provider's contractor while occupying, installing, repairing or maintaining small wireless facilities, wireless support structures or utility poles in the right-of-way and required to return the damaged property to the same condition as before the damage. If the wireless provider fails to make the repairs required by the town within a reasonable time after the town provides written notice to the wireless provider, the town may make the repairs and charge the applicable party the reasonable, documented cost of repairs.
(D) Ground-mounted equipment shall require screening and/or landscaping. Ground-mounted equipment must be constructed, maintained and located so as they do not obstruct, endanger or hinder the usual travel or public safety on the ROW.
(E) Construction, installation, mounting, maintenance, operation or replacement of utility poles and monopoles for which a permit is granted shall be completed within 180 days after the permit issuance date, unless:
(1) The town and wireless provider agree to extend the period; or
(2) A delay is caused by lack of commercial power at the site and for small cells; they must be operational within that time period.
(F) Design standards.
(1) Ground mounted equipment shall be obscured with a faux boulder cover consistent with rocks and boulders indigenous to the town.
(2) All cables will be concealed within the pole structure or a cable shroud.
(3) No more than two microwave dishes shall be permitted on a single structure or facility.
(4) Microwave dishes shall be limited to two square feet in size.
(5) All pole mounted equipment shall be installed a minimum of 12 feet above ground.
(6) The maximum allowable width of an antenna array is four feet.
(7) The antenna, whether or not part of an array, will not extend more than 24 inches from the structure to which it is attached.
(8) All microwave dishes, antennas, cable shrouds, and attaching apparatus shall be painted to match the structure.
(9) Approval of design and concealment alternatives may be considered on a case-by-case basis by the Zoning Administrator.
(G) This section does not allow a person to collocate small wireless facilities on a privately owned utility pole, a privately owned wireless support structure or private property without the consent of the property owner.
