§ 152.119 BONDS.
   (A)   The Town Engineer may require bonds in such form and amounts as may be deemed necessary to ensure that the work, if not completed in accordance with the approved plans and specifications, will be corrected to eliminate hazardous conditions. Any project requiring the cut or fill of 1,000 cubic yards or more may be required to provide an acceptable format surety bonding.
   (B)   In lieu of a surety bond the applicant may file a cash bond or instrument of credit with the Town Engineer in an amount equal to that which would be required in the surety bond.
