The following drainage requirements apply to submittals of all land subdivision Final Plats within the corporate boundaries of the town:
(A) Drainage easements shall be dedicated for the area inundated by flood waters or subject to erosion, from a 100-year developed condition peak discharge of 50 cfs or greater, or a flow depth of 1 foot or greater. The entire easement area shall be treated as a 100-year floodplain, with no building or obstruction allowed in the easement. The actual size of the easement may be modified later if, upon later analysis by a Registered Professional, it can be demonstrated that the 100-year storm runoff can be accommodated in a smaller area. The easement abandonment process must be followed to reduce the size of the easement.
(B) Tracts may be dedicated for detention/retention basins in subdivisions, including the entire inundation area, the detention inlet and outlet structures, and all areas necessary for maintenance of the facility. The owner(s) shall be solely responsible for the operation, maintenance, and liability for detention/retention systems. If there is a Homeowner's Association (HOA) established, then the HOA shall be responsible for the operation, maintenance, and liability for the detention/retention systems.
(C) Areas of “Natural Drainage Conveyance” are defined for the purposes of the town as natural drainage flow paths having a 100-year developed condition peak discharge between 5 cfs and 50 cfs or as required by the Public Works Departments. A line type approved by the Public Works Department shall be shown on the Final Plat to identify areas of Natural Drainage Conveyance. A drainage easement is not required for these areas, but is encouraged.
(D) The following general notes shall be added to all Final Plats, modified appropriately to define the maintenance entity.
(1) Areas of "Natural Drainage Conveyance" cannot be relocated without submittal of an individual lot Grading and Drainage Plan, and written approval from the Public Works Department. Any disturbance that blocks, impedes, redirects, or accelerates the drainage flow in an area of "Natural Drainage Conveyance" is prohibited.
(2) Drainage easements cannot be changed or relocated without written approval from the Public Works Department and the Town Council. Any disturbance that blocks, impedes, redirects, or accelerates the drainage flow in a drainage easement is prohibited.
