§ 71.08 TOWN ROADWAY WORK ZONES.
   (A)   Temporary reduced speed limits. The Public Works Engineer is hereby authorized to establish a temporary reduced speed limit, within town roadway work zones, for the duration of preliminary engineering work or construction, repair or maintenance work if the current established speed limit is not reasonable or safe under the existing conditions. Such reduced speed limits and the penalties set forth in division (B) of this section shall be effective when signs within the work zone are erected giving notice thereof, and any existing speed limit signs are removed, covered or turned. For the purposes of this section, TOWN ROADWAY WORK ZONE means an area that is within a town street or roadway right- of-way and that is subject to preliminary engineering work or construction, repair or maintenance work.
   (B)   Speeding in town roadway work zones prohibited. No person shall drive a vehicle on a town street or roadway within a temporary work zone at a speed greater than the existing speed limit or the temporary reduced speed posted for that zone, whichever is lower. Any violation of this section shall constitute a civil traffic violation punishable by a fine of $200. No court shall suspend the imposition of said fine of $200 or any part thereof and such fine shall be imposed in addition to any fines imposed for violation of A.R.S. § 28-701. Such fine shall only be assessed if signs have been erected upon or around the town roadway work zone which are clearly visible from the roadway and which state substantially the following: WARNING – $200 FINE FOR SPEEDING IN THIS WORK ZONE . Citations written pursuant to this section shall be heard by the Town Magistrate in accordance with the rules for civil traffic offenses heard in the Magistrate Court.
