A. Beer And Wine:
1. It shall be a misdemeanor to offer for sale, dispense, give away or consume or permit or allow to be consumed any "beer" or "wine" as the same is defined in Idaho Code sections 23-1001(a) and 23-1303(a) on the premises of any licensed vendor between the hours of two o'clock (2:00) A.M. and six o'clock (6:00) A.M. in the county. 2. Any patron present on the licensed premises after the sale of beer or wine has stopped as provided for in subsection A1 of this section, shall have reasonable time, not to exceed thirty (30) minutes to consume any beverage served prior to two o'clock (2:00) A.M.
B. Liquor By The Drink:
1. It shall be a misdemeanor to sell, offer for sale, dispense, give away or consume or permit or allow to be consumed any liquor upon any licensed premises as follows:
a. From two o'clock (2:00) A.M. on Christmas Day until ten o'clock (10:00) A.M. on the following day;
b. On any other day between the hours of two o'clock (2:00) A.M. and ten o'clock (10:00) A.M.;
c. On any day of a general or primary election until after the time when the polls are closed.
2. Any patron present on the licensed premises after the sale of liquor by the drink has stopped as provided in subsection B1 of this section, shall have a reasonable time not to exceed thirty (30) minutes, to consume any beverages served prior to two o'clock (2:00) A.M.
C. Cities: Any incorporated city within the county may, by ordinance, further limit the sale of beer, wine or liquor by the drink provided said ordinance complies with state and federal law.
D. Penalty: The penalty for a violation of this section shall be as provided in section 1-4-1 of this code. (Ord. 71, 9-3-1991, retroactive to 9-1-1991; amd. 1996 Code)
