A. Short Title: This Section shall be known as the PAYETTE COUNTY BEER AND WINE ORDINANCE.
B. Purpose: The purpose of this Section is to establish the requirements necessary to obtain a beer and/or wine license and a time period within which a decision must be made by the Board of County Commissioners following submission of an application to them for a beer and/or wine license, transfer or renewal.
C. Application To Obtain License: Application for a beer and/or wine license, transfer or renewal thereof, shall be made to the Board of County Commissioners on a form prescribed by the Board of County Commissioners which may require the information as set forth in Idaho Code section 23-1010.
D. Time Limits:
1. The Board of County Commissioners shall act upon an application for a beer and/or wine license or a transfer or renewal thereof within twenty one (21) days from the receipt of the application by the Board of County Commissioners.
2. The procedure for processing applications for beer and/or wine licenses and transfers or renewals shall be governed by Idaho Code 2 , and any rules and regulations promulgated by the Board of County Commissioners in accordance with Idaho Code title 67, chapter 52, the Administrative Procedure Act.
E. Review Of Beer And Wine Licenses:
1. Any license issued pursuant to the provisions of this Section may be reviewed by the Board of County Commissioners if the County Sheriff's office must respond to the establishment which holds the license to investigate complaints concerning the use, consumption or serving of beer and/or wine, six (6) or more times during the year in which the license is valid.
2. The review of the license shall be in conformity with the procedure for processing applications, transfers or renewals as provided in subsection D of this Section. (Ord. 38, 11-21-1983)
