2-1-4: MEMBERSHIP:
   A.   Appointment: The orchard review board shall be composed of five (5) members appointed by the Payette County board of commissioners. Two (2) of the members shall be from the commercial orchard industry, one shall be a private citizen and resident of the county with no commercial ties to the orchard industry, one member shall be a private orchardist or retired commercial orchardist or have some background or knowledge of orchard management and fruit production, and the fifth member shall be that person employed by the University of Idaho as the Payette County agricultural extension agent. All board members will be protected by Payette County errors and omissions insurance while acting in his or her capacity as a board member.
   B.   Term Of Office: The orchard review board members shall serve for a term of two (2) years.
   C.   Compensation: The orchard review board members shall serve without salary or other compensation.
   D.   Powers And Duties:
      1.   Powers: The orchard review board is vested with the power to control pests as provided in this chapter, subject to review by the board of county commissioners.
      2.   Duties: It shall be the duty of the orchard review board to review and act on all complaints involving orchard pests in orchards private or otherwise. When the board cannot resolve issues leading to the complaint, the Payette County prosecuting attorney and sheriff shall, at the request of the Payette County commissioners, assist in the enforcement of this chapter.
      3.   Notification: Any notice requirements under this chapter shall be accomplished by ten (10) days' notice in writing, to control pests identified; or if such land is unoccupied or owned by a nonresident, or the resident cannot be located, such notice shall be mailed to the owner's address, or if address is unknown, posted upon the land or premises where such pests are to be controlled.
