1-9-13: ACTION ON PROPER PETITIONS:
   A.   Upon final certification of the petition, the county clerk shall:
      1.   Promptly, by certified mail, inform the petitioners and shall also notify the Payette County commissioners at their next meeting that the initiative or referendum petition is in proper form, having the requisite number of verified signatures.
      2.   Schedule an election for the initiative or referendum to be held on the nearest date set out in subsections A2a through A2d of this section, provided that the date falls more than forty five (45) days after the county clerk has certified the petition:
         a.   The first Tuesday in February each year; or
         b.   The fourth Tuesday in May of each year; or
         c.   The first Tuesday in August of each year; or
         d.   The Tuesday following the first Monday in November of each year.
   B.   If the petition is for a referendum, the Payette County commissioners shall have thirty (30) days from the date of certification of the petition to repeal the ordinance being referred to the voters. In the event the commissioners repeal the ordinance, the referendum petition shall be declared null and void.
   C.   If the petition is an initiative petition, the Payette County commissioners shall have thirty (30) days to pass an ordinance substantially as proposed by the petition. In the event the commissioners pass such an ordinance, the initiative petition shall be null and void.
   D.   In the event the Payette County commissioners neither repeal the ordinance which is the subject of a referendum petition, nor enact an ordinance which is the subject of an initiative petition, a countywide election shall be held as set out in subsection A of this section.
