7-1-1: ADOPTION OF CODES; PENALTY:
   A.   Codes Adopted:
      1.   Building Code: The 2018 version of the International Building Code, prepared by the International Code Council, Inc., as adopted by the State of Idaho or the Idaho Building Code Board, together with any amendments or revisions to the International Building Code made by the Idaho Building Code Board through the negotiated rulemaking process;
      2.   Residential Code: The 2018 version of the International Residential Code, prepared by the International Code Council, Inc., as adopted by the State of Idaho or the Idaho Building Code Board, together with any amendments or revisions to the International Residential Code made by the Idaho Building Code Board through the negotiated rulemaking process; excepting therefrom part VII and VIII as those sections pertain to electrical and plumbing matters.
      3.   Energy Conservation Code: The 2018 version of the International Energy Conservation Code, together with any amendments or revisions to the International Energy Conservation Code made by the Idaho Building Code Board through the negotiated rulemaking process;
      4.   Abatement Of Dangerous Buildings: The current version of the International Building Code for the Abatement of Dangerous Buildings, published by the International Conference of Building Officials;
      5.   Fuel And Gas Code: The 2018 version of the International Fuel and Gas Code, together with appendices thereto;
      6.   Manufactured Home Installation Standard: The current version of the State of Idaho Division of Building Safety Manufactured Home Installation Standard, together with appendices thereto;
      7.   Recreational Vehicle Parks And Campgrounds: The current version of the American National Standard for Recreational Vehicle Parks and Campgrounds;
      8.   Buildings And Facilities Accessible To The Handicapped: The 2009 version of the American Standard Specifications for Making Buildings and Facilities Accessible to, and Usable by, the Physically Handicapped, published by the American National Standards Institute;
      9.   Fire Code: The 2018 version of the International Fire Code, published by the Western Fire Chief’s Association and the International Conference of Building Officials and National Fire Protection Association Code, published by the National Fire Protection Association, together with all amendments, additions, changes, modifications and appendices or successor codes thereto;
      10.   Public Works Construction: The current version of the Idaho Standards for Public Works Construction, together with any amendments, changes, modifications, appendices or successor codes thereto;
      11.   Mechanical Code: The 2018 version of the International Mechanical Code, published by the International Conference of Building Officials and the International Association of Plumbing and Mechanical Officials.
The adopted versions of the foregoing International Building Codes and Idaho standards shall be deemed superseded by successive versions of such codes as they are adopted by the Idaho Building Code Board effective on the date any such codes are made effective by the Idaho Building Code Board and as authorized by Idaho Code.
The above codes are hereby adopted by Payette County to provide for the regulations set forth herein and to provide for the issuance of permits and the collection of fees therefor. Three (3) copies of said adopted codes shall be kept on file in the Office of the County Clerk and are hereby made a part hereof by reference in the same manner as though fully set forth in this chapter, notwithstanding any existing conflicting section contained in this Code, which by the adoption hereof is hereby repealed.    B.   Permit Fees: Fees to enforce the above set out sections shall be established by resolution of the Board of County Commissioners. Existing fee resolutions are adopted until such time as new resolutions may be adopted. The Board shall establish a permit fee schedule which schedule shall reflect the fees which are to be charged by the official responsible for charging those fees. The fee schedule shall be kept on file in the Office of the County Clerk and in the office of the building official or building inspector and shall be made available to the public upon request. The building official shall or a designee shall charge permit fees in accordance with the schedule created by a resolution of the Board.

      2.   For statutory provision on the State Building Codes and the requirement that local governments comply with them, see Idaho Code section 39-4116.
   C.   Building Permit Required: Any person who shall build or commence construction of any building or structure without first obtaining a building permit shall be subject to and shall pay a civil penalty in an amount equal to twice the cost of the permit fee. This fee shall be paid before a permit is issued.
   D.   Penalty:
      1.   A violation of this section shall be a misdemeanor punishable in accordance with the general misdemeanor Statutes of the State of Idaho.
      2.   In addition, any building or other structure which is erected or commenced in violation of this chapter, or in violation of the codes adopted in subsection A of this section, in addition to subjecting the owner or builder to misdemeanor penalties, shall be subject to nuisance or abatement procedures, which may be brought by any County official, any member of the Planning and Zoning Commission, the Planning and Zoning Administrator, building official, building inspector or any other person.
      3.   In the event that any abatement procedure is successfully brought, the person building said structure or the owner of the property upon which the structure was wrongfully erected or commenced shall pay all court costs and attorney fees for the prosecution of that action.
      4.   A violation hereof shall be a basis to revoke an existing permit and shall be a basis for a civil abatement action. (Ord. 2014-01, 5-12-2014; amd. Ord. 2020-03, 12-28-2020)
