§ 93.60 VACANT BUILDINGS.
   (A)   Vacant residential building. A vacant residential building is a building or portion of a building which is:
      (1)   Unoccupied and unsecured; or
      (2)   Unoccupied and secured by boarding or other similar means; or
      (3)   Unoccupied and a dangerous structure; or
      (4)   Unoccupied and condemned by the city pursuant to applicable provisions of this code or the Property Maintenance Code; or
      (5)   Unoccupied and has multiple code violations; or
      (6)   Unoccupied and the building or its premises have been the site of unlawful activity within the previous six months; or
      (7)   Condemned by the city and unlawfully occupied; or
      (8)   Unoccupied for over 180 days and during which time the Code Enforcement Officer has issued an order to correct public nuisance conditions and same gave not been corrected in a code-compliant manner; or
      (9)   Unoccupied for over two years and for which at least one installment of property tax is unpaid and delinquent; or
      (10)   Defined in ILCS Ch. 65, Act 5, § 11-20-15.1 as an “abandoned residential property": being a residential dwelling unit that has been unoccupied by any lawful occupant or occupants for at least 90 days, and for which, after such 90 day period, the city has made good-faith efforts to contact the legal owner or owners of the property or, if known, the agent of the owner, and no contact has been made.
   (B)   Vacant commercial building. A building located in a commercial zoning district shall be referred to as a commercial building which is:
      (1)   A building that has not been occupied for six or more months lacking current water, electric, and/or sewer service; or
      (2)   A building at which substantially all lawful manufacturing, commercial business operations and/or occupancy has ceased, has the presence or reoccurrence of uncorrected ordinance violations, and has materials on site in violation of city ordinances all for a period of one or more months.
   (C)   Vacancy as a nuisance. Any vacant residential building and/or vacant commercial building as defined by this subchapter shall constitute a nuisance under this subchapter.
