(A) Individuals or entities operating a restaurant may be granted the privilege of encroaching upon any public highway, street, sidewalk, alley, or publicly-owned common area (hereinafter referred to as public right-of-way) of the city by the issuance of a sidewalk café. No such licenses shall be granted to any business or for any other use than a restaurant.
(B) It shall be unlawful for any person or entity to operate a restaurant on any public right- of-way without first securing a sidewalk café permit or some other applicable permit.
