§ 97.092 SOLICITATION OF DONATIONS ON PUBLIC STREETS AND HIGHWAYS.
   (A)   Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      CHARITABLE ORGANIZATION. Any patriotic, philanthropic, social service, welfare, athletic, political, benevolent, educational, civic, or fraternal organization that was organized and exists as a not-for-profit entity.
      PUBLIC WAYS. All streets, highways, and/or roadways within the city, which shall include the entire right-of-way.
      SOLICITATION. The method by which any person, business entity, firm, or corporation requests contributions or donations within the city.
   (B)   Street solicitation permission required. Any charitable organization that desires to conduct street solicitation within the city shall ask the City Council for permission subject to the following regulations:
      (1)   The charitable organization shall ask permission at least 30 days, but not more than 180 days, in advance of the date that the organization wishes to conduct a street solicitation.
      (2)   Any person engaged in the act of solicitation shall be 16 years of age or more and shall wear a high visibility vest.
      (3)   The charitable organization shall specify a maximum of two intersections where street solicitations are sought to be conducted.
      (4)   No charitable organization may receive permission for no more than two street solicitations in any given calendar year.
      (5)   Solicitations shall only be allowed at intersections where traffic is required to come to a complete stop.
      (6)   Solicitations shall not interrupt the flow of traffic, nor endanger any of the persons soliciting funds, pedestrians, and the drivers and passengers of the vehicles.
   (C)   Fraud. It shall be unlawful for any charitable organization to cheat, deceive, or fraudulently misrepresent whether through himself or herself, or through an employee or agent, while soliciting funds, or to solicit funds other than those specified to the City Council.
   (D)   Revocation. Any permission issued under this section may be revoked by the Mayor because of any violation of this section.
