§ 95.28 PUBLIC AND TENANT USAGE.
   (A)   Disorderly conduct. No person shall be or become intoxicated or drunk, commit any disorderly, obscene or indecent act or commit any act of nuisance, nor conduct or engage in any form of gambling on the airport.
   (B)   Sanitation. No person shall dispose of garbage, papers, refuse or other material on the airport except in the receptacles provided for that purpose; nor use a comfort station other than in a clean and sanitary manner; nor eat food or drink beverages in the terminal building lobby, other than the soft drink and candy normally sold in the building; nor expectorate on the floors, walls or other surfaces of any airport building.
   (C)   Preservation of property. No person shall destroy, injure, deface or disturb in any way any building, sign, equipment, marker or other structure, trees, flowers, lawn or other property on the airport; nor alter, make additions to or erect any building or sign or make any excavations on the airport; nor wilfully abandon any personal property on the airport.
   (D)   Weapons, explosives and inflammable materials. No person except peace officers, duly authorized post office, airport and air carrier employees or members of the Armed Forces of the United States on official duty shall carry any weapons, explosives or inflammable material on the airport except cases sporting guns carried for transhipment.
   (E)   Interfering or tampering with aircraft. No person shall interfere or tamper with any aircraft or put in motion the engine of such aircraft or use any aircraft, aircraft parts, instruments or tools without permission of the owner or by specific direction of the Airport Manager.
   (F)   Restricted areas. No person shall enter upon the field area, control tower, utilities and service rooms or areas or other areas as may be designated restricted, except:
      (1)   Persons assigned to duty therein;
      (2)   Persons authorized by the Airport Manager;
      (3)   Passengers, under appropriate supervision, entering the apron for the purpose of embarkation or debarkation.
   (G)   Use of roads and walks.
      (1)   No person shall travel on the airport other than on the roads, walks or places provided for the particular class of traffic.
      (2)   No person shall occupy the roads or walks in such a manner as to hinder or obstruct their proper use.
   (H)   Animals. Animals will not be permitted in any building or other areas of the Paxton Airport, with the exception of seeing-eye dogs or animals properly confined for transportation, without the approval of the Airport Manager.
   (I)   Loitering. No person shall loiter on any part of the airport or in any building on the airport; nor shall any person come upon or use the airport, except while traveling through as a passenger on an interstate bus or taxicab or while enplaning or deplaning as a passenger on an aircraft operating on the airport, after such person has been denied the use of the airport by the Airport Manager. Any person or persons who shall refuse to comply with these applicable rules and regulations, after proper request to so do by the Airport Manager or other authorized representative, shall be requested to leave the airport; and in the event of his or her failure to comply with a proper request to abide by the rules and regulations of the city shall be regarded as a trespasser.
   (J)   Use of shop areas. All shops, garages, equipment and facilities are expressly for the conduct of the owner’s or lessee’s business and operations. No persons other than employees of the owner or lessee shall make use of these facilities or loiter around such premises without individual and specific permission of the owner or lessee. This section applies to the city premises as well as all others.
   (K)   Open flame operations. No person shall conduct any open flame operations except at certified repair shops and approved areas.
   (L)   Smoking. No person shall smoke on the airport apron in any hangar or shop, service station area, gasoline storage area or in any building, room or place on the airport where smoking is specifically prohibited or within 100 feet of any fueling or defueling operation.
   (M)   Trash containers. No person shall keep uncovered trash containers in any area. No vehicle used for hauling trash, dirt or any other material shall be operated on the airport unless such vehicle is constructed so as to prevent the contents thereof from dropping, sifting, leaking or otherwise escaping therefrom. Areas to be used for trash or garbage containers shall be designated by the Airport Manager, and no other areas shall be used. Such areas shall be kept clean and sanitary at all tires.
   (N)   Solicitation. The soliciting of fares, alms or funds for the purpose of the airport without the permission of the Airport Manager is prohibited.
   (O)   Damages. Tenants, lessees and grantees shall be fully responsible for all damages to buildings, equipment, real property and appurtenances in the ownership or custody of the city caused by their negligence, abuse or carelessness or caused by the negligence, abuse or carelessness on the part of their employees, agents, customers, visitors, suppliers or persons with whom they may do business.
   (P)   Default of obligations.
      (1)   All billings are payable upon presentation, unless otherwise noted thereon.
      (2)   When any tenant, user or grantee is formally notified that he or she is held in default of any written or implied obligation to the city whether it be for breach of performance or service covenants or nonpayment, he or she will thereafter be billed for all losses of revenue, expenses incurred to reestablish performance or service and other costs unless the tenant, user or grantee files with the Airport Manager with ten days of receipt of the formal notification a statement that corrective or preventative measures have been initiated and will diligently be carried to completion. If the promises contained in the statement are not fulfilled, the tenant, user or grantee will be considered in absolute default and appropriate lawful steps will be taken by the city.
   (Q)   Use of automobiles and vehicles on airstrip parking ramp. Automobile parking in any aircraft use area shall be restricted to emergency vehicles and certain authorized vehicles of airport personnel, as determined by the Airport Manager. Temporary usage will be permitted for purposes of unloading and loading passengers and baggage.
   (R)   Commercial activities. No person shall use the airport as a base or terminal for the carrying on of commercial aviation, including but not limited to fixed-base operations; aircraft maintenance; scheduled or nonscheduled aircraft carriers carrying passengers, freight, express or mail; or student instruction, communications or any other commercial flight without a current lease or operating agreement authorizing such activities with the city. No person shall engage or employ any person to provide commercial activity services as defined in the preceding sentences except from those persons officially authorized by the city to conduct such commercial activities on the airport.
