§ 90.01 CITY CONTRIBUTION TOWARD COST OF TOPPING CERTAIN TREES.
   (A)   The city will contribute toward the cost of the topping of trees located on city property as hereinafter provided.
   (B)   The property owner shall notify and receive permission from the Superintendent of Streets before topping. Also, the Superintendent is to be notified upon completion of work for approval. The property owner shall hire any qualified tree trimmer and shall assume all liability, including payment. The Superintendent will determine the cost to the city according to the size and height of the tree. The basis for the amount of city contribution shall be as follows:
      (1)   Twenty dollars for any qualifying tree that is 35 feet to 45 feet in height;
      (2)   Twenty-five dollars for any qualifying tree that is 45 feet to 55 feet in height;
      (3)   Thirty dollars for any qualifying tree that is over 55 feet in height.
   (C)   After inspection and approval by the Superintendent of Streets, as aforesaid, a bill from the property owner for the designated amount is to be sent to the City Clerk for payment.
   (D)   Certain tree species are not acceptable for topping purposes and they will not be approved for contribution payment. The non-acceptable trees are as follows: Tree of Heaven, Willow, Boxelder, Poplar and Catalpa. This list may be added to in the future as the city may deem necessary.
   (E)   Tree species acceptable for contribution payments are as follows: Ash, Birch, Buckeye, Chestnut, Cherry, Cottonwood, Coffee Tree, Elm (American type), Gingko, Maple, Oak, Tulip, Sycamore and Walnut.
