(A) The city shall request the owner/operator to enter into a supplemental agreement, in addition to the highway authority agreement.
(B) The owner/operator shall compensate the city up to a predetermined amount, above and beyond the minimum fee set for the cost of hiring a consultant to assist the city in the drafting and review of the supplemental agreement. The Mayor shall establish the pre-determined amount for each supplemental agreement, in consultation with the Superintendent, in order to reasonably anticipate the consultant costs that will be incurred for that supplemental agreement. The fee shall consider and include the cost to the city of entering into a highway authority agreement.
