§ 51.51 WATER METERS.
   (A)   Meters required.
      (1)   All premises using the city water supply must be equipped with a radio read register water meter furnished by the city but paid by the customer; provided, however, that such water service may be supplied by the city at a flat rate of charge until such meter may be installed.
      (2)   Before any premises are occupied, a radio read register water meter shall be installed therein as herein required or application made for such water service at the flat rate of charge until the meter can be installed or no water shall be furnished to such premises.
   (B)   Location. Water meters shall be installed in a location that will be easy to access and permits the sending of electronic data to the receiver of the city.
   (C)   Notwithstanding the requirement set forth in division (A)(1) of this section that the customer shall pay for the water meter, commencing on July 1, 2011, and continuing through, and including, June 30, 2012, the city will replace in each premises each water meter existing therein as of July 1, 2011, with a radio read register water meter at the sole cost and expense of the city. The replacement radio read register water meter will be furnished by and installed by the city during this period of time.
   (D)   In the event the owner of a premises denies the city access to the premises in order to install a radio read register water meter, the water supply shall be shut off from any premises for which a radio read register water meter remains uninstalled for a period of ten days after notice to install a radio read register water meter is posted on the premises or given to the owner of the premises. When shut off, water shall not be turned on except upon the installation of a radio read register water meter and upon payment of the usual fee for turning on water.
   (E)   All water meters are the property of the owner of the premises, however, any and all repairs to water meters shall be made by the city. If a meter is damaged by the carelessness or negligence of the consumer, occupant or owner of the premises, the city will repair the meter, and the cost of repairs shall be charged to the owner and against the property.
