§ 51.44 PLACE OF INSTALLATION.
   All plants, works, mains, services, conduits, pipes, tanks and apparatus erected, installed or placed for sanitary sewer mains, storm sewers and water mains shall be located in parkways or alleys or public right-of-ways designated for utilities whenever practicable so to do and shall be located, whether in roads, streets, alleys, avenues, bridges, parkways or other public places, all hereinafter referred to as public grounds, so as not to interfere unnecessarily with the use of such public grounds. All sanitary sewer mains, storm sewers and water mains installed under this chapter shall be located so as not to injure or damage unnecessarily any of the public grounds, drains, storm sewers, catch basins or other like improvements, but should any of the public grounds, drains, storm sewers, catch basins or other like improvements be injured by such location, the contractor installing the same shall forthwith repair the damage caused and restore the public grounds, drains, storm sewers, catch basins or other like improvements to as good condition as existed prior to undertaking such work. In case the contractor refuses or neglects to repair any of the public grounds, drains, storm sewers, catch basins or other like improvements within a reasonable time after work is completed, and notice in writing of such refusal or neglect shall have been given by the city to the contractor, the City Council may direct the necessary repairs thereof to be made at the expense of the contractor, and the contractor shall be responsible for all damages sustained by any person or persons by reason of such refusal or neglect on the part of the contractor.
