§ 33.24 TIME LIMITS.
   (A)   Unless otherwise agreed by the city in writing, any grievance not presented by any grievant within the applicable time limit set above shall be considered waived and shall not be further pursued. If any grievance is not appealed to the next step within the specified time limit or any agreed extension thereof, it shall be considered settled on the basis of the city's last response. If the city does not respond to any timely filed grievance or any timely filed appeal thereof within the specified time limits for any such response, the grievance shall be considered denied at that step and immediately appealed to the next.
   (B)   Grievances may be withdrawn at any step of the grievance procedure without prejudice.
   (C)   Grievances concerning suspension of 30 days or less of an employee may be initiated at Step 2 of this grievance procedure.
   (D)   Grievances concerning suspension of more than 30 days and/or discharge of an employee shall be initiated at Step 3 of this grievance procedure.
