The Police Department may in its discretion refer charges of possession of cannabis to the States Attorney for charges pursuant to State law instead of bringing charges pursuant to this chapter, but no person shall be charged pursuant to this chapter and State law for the same offense. Possession of cannabis in excess of thirty grams (30 g) is not subject to this chapter, but rather, shall be referred to the States Attorney to be charged pursuant to State law. (Ord. 16-10, 8-8-2016)
