2-2-15-1: CONSUMPTION OF ALCOHOL ON PUBLIC WAYS:
   A.   No person shall consume, sell, pour, or provide any alcoholic liquor on any public way or right of way, including, but not limited to, public highways, streets, alleys, and sidewalks, unless specifically authorized pursuant to: 1) a special event permit issued by the state of Illinois which has been approved by resolution of the corporate authorities or 2) a special event license for the annual event known as “Pawnee Prairie Days”.
   B.   No licensee hereunder, other than as authorized pursuant to: 1) a special event permit issued by the state of Illinois which has been approved by resolution of the corporate authorities; or 2) a special event license issued by the village pursuant to subsection 2-2-12G of this chapter, shall allow any customer or patron to enter or exit the licensed premises onto any public way or right of way, including, but not limited to, public highways, streets, alleys, and sidewalks, with an open container containing alcoholic liquor.
   C.   During the term of the Executive Orders issued by the Governor of the State of Illinois in calendar year 2020, the terms of liquor licenses issued by the Village of Pawnee shall include the opportunity to serve alcohol in alleys adjacent to the licensed premises, on the following terms:
      1.   Outside service will be allowed on public ways only on Friday and Saturday, at times as established by the Liquor Commissioner.
      2.   All patrons must enter and exit the licensed premises through the front door of the premises.
      3.   All patrons must be at tables in the alley. Each licence holder must provide tables and chairs in the alley. No more than 10 patrons are allowed at any one table.
      4.   The licensee must provide porta potties and a hand-sanitizing station in the alley.
      5.   The alley must be cleared and cleaned by the licensee each night, so there will be no interference with regular daily activities in the alley.
      6.   Staff of the licensee must deliver all drinks and/or food to the tables. Staff must wear appropriate facewear and gloves.
      7.   Live music may be allowed with the permission of the Liquor Commissioner.
      8.   The hours of service for all on-premise service pursuant to a Pawnee Liquor License during this period shall terminate at 1 a.m. for all classes of Licenses, notwithstanding the provisions of 2-2-12 of this Code.
      9.   The Liquor Commissioner may make additional rules relating to outdoor service of alcohol as may be necessary. (Ord. 10-23, 7-12-2010; amd. Ord. 15-06, 5-13-2015; Ord. 21-18, 10-25-2021)
