A person who operates or causes to be operated a sexually oriented business without having a valid permit due to locational restrictions is subject to a suit for injunction as well as prosecution for the criminal violation. Such violation shall be punishable by a fine of three hundred dollars ($300.00) and/or thirty (30) days' imprisonment, and if an injunction must be sought, attorney fees and costs may be assessed by the court against the sexually oriented business.
