Violation of § 91.01 shall be punishable as a misdemeanor. If the charging citation alleges and the court finds that the prosecution is based on the failure of the accused to abate a nuisance or detriment to the public health within the time required by a notice delivered or posted in conformity with § 91.02, violation of §§ 91.01 or 91.02 shall be punishable as an unclassified misdemeanor and the court shall order payment of restitution to the village in the amount of all service fees the court determines to be due and owing in accordance with § 91.06 as part of any sentence imposed upon conviction, and the fine shall be no less than $250 and no more than $500.
