§ 52.45 RATES TO BE CHARGED FOR SERVICES SUPPLIED.
   (A)   Commencing January 1, 2013, and each year thereafter, the Village Administrator shall be and hereby is authorized to incorporate an annual rate increase in an amount not to exceed 3% into Exhibit 6 entitled “Nonresidential Sewer Service Schedule No 2" of Ord. 1198-98 for nonresidential sewer service customers located inside the village and an amount equal to two and one-half times the inside village rate for nonresidential and commercial sewer service customers located outside the village limits.
   (B)   Commencing January 1, 2013, and each year thereafter, the Village Administrator shall be and hereby is authorized to incorporate an annual rate increase in an amount not to exceed 3% into Exhibit 5 entitled “Residential Sewer Service Schedule No. 1" of Ord. 1198-98 for residential sewer service customers located inside the village and an amount equal to two and one-half times the inside village rate for nonresidential and commercial sewer service customers located outside the village limits.
   (C)   The Village Administrator shall advise the Village Council prior to December 1 of each year as the amount of rate increase, if any, that will be place into effect on January 1 of the following year.
   (D)   Said attached rates, charges, general rules and regulations and related matters shall, when placed into effect as provided herein, supersede all existing rates, charges, by-laws, regulations and the like, related to the matters covered by this section and thereafter all of the provisions set forth in this section shall be in full effect.
   (E)   The Village Administrator shall place in effect the attached rates, charges, rules and regulations and related matters at the earliest practical date following the effective date of this section as provided by law, taking into consideration the billing changes and other related matters involved, and this section shall take effect and be in full force from and after the earliest period allowed by law.
   (F)   Schedule No. 1.
   SCHEDULE NO. 1 “RSS”
   RESIDENTIAL SEWAGE SERVICE
Availability and Applicability:
      (1)   Sewage service is available only for individual residence, apartments, mobile homes or other dwelling units where village’s sanitary sewer lines are already installed immediately adjacent to consumer’s premises. New sewage connections will not be made if village’s water is available to premises and not utilized.
      (2)   The sewage rate is based upon water usage and the residential water rate classification and definition shall likewise be applicable for sewage service.
      (3)   The furnishing and utilization of sewage service, including system extensions or enlargements and the financing of same, shall conform to village’s application form and general rules and regulations of which are a part of this schedule as if fully written herein.
New Rate per Month or Part Thereof per Service:
      (1)   Generally. The net billing shall be the sum of the charges (a), (b) and (c) below. The village may elect to read meters monthly or bi-monthly. If read bi-monthly, the service charge and rate blocks set forth below will be multiplied by two.

      (2)   Capacity of service. The capacity of service shall be the nominal inside diameter in inches of the water service line supplying consumer. Where the service line is larger than one and one-half inches nominal diameter, the nonresidential and commercial schedule shall apply.

Billing for Multiple Dwelling Units:
      (1)   Where more than one dwelling unit (not to exceed four) is served through a single meter, there shall be added to the regular billing under the rates set forth herein an additional $5.29 per month inside the village and $13.23 per month outside the village limits for each additional service where sewer is discharged into the same sewage service line connection.
      (2)   The village reserves the right to require all future multiple dwelling units or apartments to be individually metered and plumbed before service is established.
Terms of Payment: The foregoing rates and charges are net and already reflect the discount applicable from the gross rates if all accounts are paid on or before the date specified on the bill. If all accounts are not so paid, the gross rates and charges (which are 10% but not less than $1 higher than the foregoing net rates and charges) shall apply.
Optional Special Metering for Sewage Billing Purposes:
      (1)   For water use that does not discharge into village’s sanitary sewer system (lawn sprinkling, irrigation, air conditioning and the like), such water will not be subject to village’s sewage charge providing the following conditions have been complied with:
         (a)   That it can be demonstrated to the satisfaction of the Village Administrator that it will be impossible for the water use in question to enter into village’s sanitary sewer system. To meet this requirement, such water shall be discharged into village’s storm sewer or into the ground or into the street gutter or ditch. Furthermore, such water shall not be discharged into any combination storm and sanitary sewer;
         (b)   1.   That the Administrator determines that such wastewater will consist substantially of unpolluted or “clean wastewater”, free from objectionable odor and will have no harmful or objectionable polluting affect upon any stream, underground water supply or other body of water into which such “clean wastewater” will ultimately be discharged - either directly or indirectly.
            2.   The entire plumbing and meter installation shall meet the village’s specifications and approval and shall be installed, owned and maintained at property owner’s expense. The meter installation and location shall be determined by the village.
            3.   Where the regular meter is an outdoor “frost-free” pit installation, the “clean wastewater meter” shall be connected to the outlet side of same;
            4.   Where the special meter supplies an underground lawn sprinkler system, the piping system shall be provided with a suitable drain cock, so that said sprinkler piping system can be drained in order to prevent freezing; and
            5.   For such special meter installations, the applicable regular minimum charge shall apply for both water and sewage billing. There will be no minimum charge for the special meter. In determining the water use for sewage billing, the special meter water use shall be deducted from the regular meter total use.
         (c)   The property owner may elect to connect the special “clean wastewater” meter and separate plumbing system ahead of the regular meter. In such an event, the water usage of each meter will be billed separately and only the regular meter use shall be subject to the sewage charge. However, the applicable minimum charge for water service shall apply to each water meter. In addition, the applicable sewage charge shall apply to the regular meter.
      (2)   All meters shall be subject to village’s turn-off and turn-on charge.
Billing and Meter Readings: Each metered water use shall be separately billed and no meter readings shall be combined for billing purposes. The rates and minimum charge shall be applied as written, with no proration for a fractional billing period.
Deposit and Responsibility for Payment of Bills:
      (1)   For all service furnished within the corporate limits of the village, the current property owner of record of the land involved is responsible for all bills for sewage service - irrespective of who incurred such unpaid bills or when such bills were incurred or who owned or occupied the property at the time such bills were incurred. Said unpaid sewage service bills shall be assessed as a tax lien against the property involved.
      (2)   Without relieving the property owner of his or her responsibility for payment of all sewage bills for service furnished within the corporate limits and in all cases where service is furnished outside the corporate limits, the village reserves the right to require a suitable deposit to secure payment of sewage bills. See the village’s general rules and regulations. Failure to pay any sewage bill will cause water service to be turned off.
Sewage Service and Tap Charge: The initial establishment of sewage service is subject to payment by the applicant, the village’s applicable sewer service and tap charge.
Line Extensions: Where an extension or enlargement of the village’s sewer line is required, the same shall be paid for by the consumer’s involved and in accordance with the provisions set forth in the village’s line extension policy and in the village’s general rules and regulations.
Other Conditions:
      (1)   Where sewage is discharged into the village’s sewer system and water is obtained from a source other than from the village, the village reserves the right to require property owner to install (at his or her own expense) suitable, frost-free water or sewage metering equipment (to be approved by the village) in order to determine the amount of sewage being discharged into the village’s sewer system and to properly apply the foregoing rates and charges. The property owner may also elect to install (at his or her own expense) said metering equipment.
      (2)   Where consumer’s water supply is from a source from other than the village and proper water or sewage metering equipment is not installed, the village shall estimate the monthly sewage charge which shall be three times the estimated sewage charge which would otherwise be made for residence to comparable size and sewage discharge.
      (3)   Where sewage service is furnished outside the corporate limits of municipality and it becomes necessary to renew or replace sewage treatment faculties, including pumps and other appurtenances, the rates and charges set forth herein are subject to increase to the extent necessary in order to pay for such additional costs.
   (G)   Schedule No. 2.
   SCHEDULE NO. 2 “CSS”
   NONRESIDENTIAL, COMMERCIAL AND INDUSTRIAL SEWAGE SERVICE
Availability and Applicability:
      (1)   This schedule is applicable for all service that is not strictly residential in character. The rate to be charged for sewage service is based upon water usage and/or the sewage discharged into village’s sanitary sewer system. The village’s water rate classification and definition for nonresidential and commercial service shall likewise be applicable for sewage service.
      (2)   The furnishing and utilization of sewage service, including system extensions or enlargements and the financing of same, shall conform to village’s application form and its general rules and regulations of which are a part of this schedule as if fully written herein.
New Rate per Month or Part Thereof per Service: The net billing shall be the sum of the charges set forth under divisions (1), (2) and (3) below. The village may elect to read meters monthly or bi-monthly. If bi-monthly, the service charge and rate blocks will be multiplied by two.

Capacity of Service:
      (1)   The capacity of service shall be determined by the village and shall normally be equal to the nominal inside diameter in inches of the service line installed by the property owner, extending from the tap on the village’s main to consumer’s meter.
      (2)   Where the service line is larger than two inches nominal inside diameter and is used to supply schools, churches, hospitals, bona fide charitable institutions and tax supported public buildings located within the corporate limits of village, the capacity charge shall be 50% of the otherwise applicable charge set forth above, but not less than $26.45.
      (3)   The billing as determined above, shall be subject to the applicable minimum charge. Where more than one establishment discharges sewage into the same sewage service line connection, see “Billing for Multiple Establishments”.
      (4)   See elsewhere as to billing where the village does not furnish water service and/or where water use is not discharged into village’s sanitary sewer system; also where the sewage discharge has a deleterious effect on the operation of the village’s treatment plant or sewer system.
Billing and Meter Readings: Each metered water use shall be separately billed and no meter readings shall be combined for billing purposes. The rate and minimum charges shall be applied as written, with no proration of the same for a fractional billing period.
Billing for Multiple Establishments:
      (1)   The foregoing rates are based upon a single sanitary sewer service line connection into which the sewage is discharged from not more than a single establishment, business, activity or premises. Where more than a single establishment, firm, business or activity discharges sewage into a single sewer connection and/or is served through a single water meter, there shall be added to the regular billing under the rates set forth herein, an additional charge of $5.29 per month inside village limits and $13.23 per month outside village limits for each such additional establishment, firm, business or activity whose sewage is discharged into the same sewage service line connection.
      (2)   The village reserves the right to require that all future business establishments or activities located on the same premises to have the water service individually plumbed, metered and billed, before service is established.

      (2)   Where multiple establishments or businesses are served through one sewer connection and/or one water meter, the applicable above minimum charge shall be increased as provided under “Billing for Multiple Establishments”.
      (3)   For non-profit public activities such as county fairs, athletic fields, swimming pools and the like, the minimum charge shall be applicable during the months that service is turned on, but not less than three consecutive months.
      (4)   The minimum charge shall apply every month that a bill is rendered for water service and/or consumer’s building sewer is connected to the village’s sewer system.
Terms of Payment: The foregoing rates and charges are a net and already reflect the discount applicable from the gross rates if all accounts are paid on or before the date specified on bill. If all accounts are not so paid, the gross rates and charges, which are 10%, but not less than $1 higher than the foregoing net rates and charges, shall apply.

Failure to pay the sewage bill shall cause water service to be curtailed as specified in the village’s general rules and regulations for sewage service.
Optional Special Metering for Sewage Billing Purposes:
      (1)   For water use that does not discharge into village’s sanitary sewer system (lawn sprinkling, irrigation, air conditioning and the like) such water will not be subject to village’s sewage charge providing the following conditions have been complied with:
         (a)   It can be demonstrated to the satisfaction of the Village Administrator that it will be impossible for the water use in question to enter into village’s sanitary sewer system. To meet this requirement, such water shall be discharged into village’s storm sewer or into the ground or into the street gutter or ditch. Furthermore, such water shall not be discharged into any combination storm and sanitary sewer;
         (b)   The Administrator determines that such wastewater will consist substantially of unpolluted or “clean wastewater”, free from objectionable odor and will have no harmful or objectionable odor and will have no harmful or objectionable polluting affect upon any stream, underground water supply or the body of water into which such “clean wastewater” will ultimately be discharged - either directly or indirectly;
         (c)   1.   That the property owner shall separate his or her plumbing so that the water input that is ultimately discharged as “clean wastewater” will be separately metered.
            2.   The entire plumbing and meter installation shall meet the village’s specifications and approval and shall be installed, owned and maintained at the property owner’s expense. The meter installation and location shall be determined by the village.
            3.   Where the regular meter is in outdoor “frost-free” pit installations, the “clean wastewater meter” shall be installed immediately adjacent to the regular meter and shall be connected to the outlet side of the same.
            4.   Where special meter supplies an underground lawn sprinkler system, the piping system shall be provided with a suitable drain cock, so that said sprinkler piping system can be drained in order to prevent freezing.

      (2)   All meters shall be subject to village’s “turn-off’ and “turn-on” charge.
Billing Where Water Is Not Supplied by Village: Where the consumer’s water supply is from a source from other than the village and proper water or sewage metering equipment is not installed, village shall estimate the monthly sewage charge which shall be three times the estimated sewage charge which would otherwise apply for said estimated sewage discharge to the village’s system.
Restrictions as to Discharge of Objectionable Waste into Village’s Sanitary Sewer:
      (1)   Wastes discharged into the village’s sewer system that are deleterious to the normal operation of the village’s sewage treatment plant are prohibited. The Village Administrator shall determine by analysis and tests whether or not wastes or rate of flow of same are deleterious or objectionable to the operation of village’s system, based upon the kind of waste and its volume, rate of flow and frequency of discharge into village’s system, plus other factors.
      (2)   The wastes and/or other conditions that are subject to determination by the Village Administrator as being objectionable shall be those specified in the village’s general rules and regulations covering sewage treatment service.
      (3)   At the village’s option, the village may, as provided in said general rules and regulations, apply the specified surcharge to the rates set forth herein, to compensate for the additional expense involved to treat such objectionable sewage.
Other Provisions and Conditions
      (1)   The installation, operation and all other matters pertaining to sewers shall be subject to all of the regulations, requirements and provisions set forth in the village’s general rules and regulations pertaining to sewage service and sewers, including any amendments or revisions thereof.
      (2)   Where sewage is discharged into the village’s sewer system and the companion water supply is obtained from a source other than from the village, the village reserves the right to require the property owner to install at his or her own expense, suitable frost-free metering equipment to be approved by the village, in order to determine the amount of sewage being discharged into the village’s system and to apply the foregoing rates and charges accordingly.
      (3)   Where the village’s water service is available, the village reserves the right to refuse to allow the discharge of sewage or waste into its sanitary sewer system unless consumer obtains all of his or her water requirements from the village.
      (4)   New sewage connections will not be made except to areas located within the village corporate limits.
      (5)   Where existing sewage service is furnished outside the corporate limits of municipality and it becomes necessary to renew or replace sewage treatment facilities, including pumps and other appurtenances, the rates and charges set forth herein are subject to increase to the extent necessary in order to pay for such additional costs.
      (6)   For other conditions pertaining to service application, charges for disconnection and reconnection of service, new extensions, responsibility for bill payment and other conditions are set forth in village’s general rules and regulations, available at village’s Utility Office, which are part of this schedule the same as if fully written herein.
