(A) Building sewer maintenance - village.
(1) For building sewers that do not have an approved inspection and cleanout riser. The village will maintain the building sewer from the property line to and including the sewer tap at the trunk line sewer.
(2) For building sewers that have an approved inspection and cleanout riser. The village will maintain the building sewer from and including the inspection and cleanout riser to and including the sewer tap at the trunk line sewer.
(B) Building sewer maintenance - property owner. If the property does not have an approved inspection and cleanout riser and has an obstruction in his or her building sewer, it is the property owner’s responsibility to determine that the obstruction is not between his or her building and the property line. If the property owner determines that the obstruction is in the street right-of-way, it becomes the responsibility of the village. If the village has to excavate or use other means to determine that the obstruction is actually on the property owners side of the property line, the cost involved for the time and materials used by the village shall be charged to the property owner. An inspection and cleanout riser shall be installed either by the village, property owner or contractor.. The complete installation shall be at the expense of the property owner. The property owner shall also be responsible for the backfill and replacement or repair of sidewalks, curbs and streets. Regardless of who made the installation, the property owner is responsible for the permit and inspection fee.
(C) If obstruction is in street right-of-way. The village will excavate to the building sewer. The village will replace, clean or repair the building sewer. An inspection and cleanout riser shall be installed either by the village, property owner or contractor at the expense of the property owner. Such installation shall include the installation and connection of the “Y” to the building sewer. At the request of the property owner, the village will backfill the trench. The village will either leave the material to settle or level it even with the ground surface at the request of the property owner. If it is leveled, the property owner will be responsible to fill and keep level to the ground surface to areas that will later settle. The property owner shall be responsible for the replacement of any sidewalk or curbing that was removed or damaged. Regardless of who made the installation, the property owner is responsible for the permit and inspection fee.
(D) Installation of inspection and cleanout riser at property owners request. If the property owner is not having a problem with his or her building sewer but requests that an inspection and cleanout riser be installed, the complete installation of the inspection and cleanout riser shall be the responsibility of the property owner or his or her contractor and the complete cost of the installation shall be the responsibility of the property owner. The property owner is responsible for the permit and inspection fee.
(E) Common building sewer. Where two or more properties use the same building sewer, the village will be responsible only to the property line of the first property served.
