§ 52.22 GENERAL CONDITIONS.
   (A)   Authority. The Village Council authorizes the Administrator to formulate and enforce rules and regulations governing policies essential to the operation of the treatment works under its jurisdiction.
   (B)   Operation and control. The public and wastewater treatment works of the village, including all appurtenances, are under the operation of the Administrator and his or her authorized agents and employees. Such control shall include all phases and fixtures of sewerage works from the point of usage to the ultimate discharge to receiving watercourse.
   (C)   Effective date. These rules and regulations shall be effective on the date of adoption of a resolution by the Village Council and may be amended from time to time.
   (D)   Validity. Should any section or individual provision of the rules and regulations be decided by the courts to be unconstitutional or invalid, such a decision shall not affect the validity of the rules and regulations as a whole or any part thereof, other than that particular portion so held to be unconstitutional or invalid.
   (E)   Enforcement. These rules and regulations shall be enforced by the Administrator, as directed by the Village Council.
   (F)   Violation. Any infractions of the rules and regulations is a violation. Any person, firm, group or corporation, either owner or agent who tampers with or attempts to use facilities provided by the village without first obtaining the necessary permits and approvals is in violation of the rules and regulations. Any person, firm, group or corporation, either owner or agent, that obtains a permit or approval based on false information made in order to deceive the village shall be held in violation of the rules and regulations.
   (G)   Misdemeanor. Any person or corporation found to be violating any provision of the general rules and regulations except division (H) below shall be served by the Administrator with written notice stating the nature of the violation and providing a reasonable time limit for the satisfactory correction thereof. The offender shall, within the period of time stated in such notice, permanently cease all violations or be guilty of a misdemeanor.
   (H)   Protection from damage. No unauthorized person shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with any structure, appurtenance or equipment which is a part of the sewage works.
   (I)   Jurisdiction. These rules and regulations are applicable to all persons within the village or any other persons receiving sanitary service from the system operated by the village.
   (J)   Agreement. All persons, successors and assigns obtaining a permit from the village accept and agree to be bound by these rules and regulations.
   (K)   Interpretation. The provision of these rules and regulations shall be the minimum requirements adopted for the promotion of health, safety and welfare of the constituents of the village. These rules and regulations are not intended to repeal, abrogate, annul or in any manner interfere with any laws or rules of any governmental units having jurisdiction that are more stringent. Where these rules and regulations impose greater restrictions than those of existing laws or rules, then the provisions of these rules and regulations shall govern. These rules and regulations may be promulgated by the Administrator to cover unusual situations.
   (L)   Personnel. Inspectors, meter readers, employees or representatives of the village whose duty constitutes entrance upon private property shall be equipped with proper credentials as the village may deem necessary to identify them as agents of the village. Such authorized employees shall have access to the premises for the proper operation and maintenance of the village facilities. Should access of the premises be denied, the village shall discontinue service and will not restore same until time as access is granted.
   (M)   Termination of service. The Administrator shall have the right to terminate sewer service immediately if it is determined that the violation produces a dangerous, toxic, odorous, destructive or other condition which in the opinion of the Administrator cannot be tolerated.
   (N)   Limitation of access. The Administrator shall have the right to limit sewer service if such connections will overload the treatment works as a whole or in part, or will be detrimental to the intended design of the treatment works.
   (O)   Limitation of wastewater parameters. The Administrator shall have the right to control the quantity and quality of all wastewater discharged to the treatment works. Such rights could result in the establishment or individual discharge permits, pretreatment, facilities, flow equalization facilities or monitoring facilities.
   (P)   Public purposes. Special terms and conditions may be made where sewer service is used by the municipality or community for public purposes such as public parks and the like.
