§ 92.99 PENALTY.
   (A)   In addition to any other remedy provided in §§ 92.01 through 92.07 of this code or under any other applicable law, any person or persons violating any provision of §§ 92.01 through 92.07 shall be punished by a fine not to exceed $1,500. Each day’s continued violation shall constitute a separate offense.
   (B)   (1)   Any person who violates the provisions of § 92.20 of this code shall be subject to the following fines (escalating fines shall be measured on a calendar-year basis):
         (a)   First offense: $1,000;
         (b)   Second offense: $1,500;
         (c)   Third offense: $2,000; and
         (d)   Subsequent offenses: $3,000.
      (2)   Each day a violation occurs shall constitute a separate offense.
      (3)   The enforcement of a first offense within a calendar year shall be within the jurisdiction of the town.
      (4)   All enforcement of offenses subsequent to the first offense within a calendar year shall be within the jurisdiction of the town.
      (5)   A custodial parent shall be responsible for ensuring that any child under 18 years of age complies with § 92.20 and is responsible for any fine imposed.
      (6)   Citations for violation of § 92.20 may be issued by any sworn member of the town, the Town Marshal, the Town Code Enforcement Officer(s) or designated town employees, or by any sworn special police officer.
