§ 51.044 WATERSHED PROTECTION OCCUPANCY PERMIT.
   (A)   The Administrator or his or her designee shall issue a watershed protection occupancy permit certifying that all requirements of this chapter have been met prior to occupancy or use of a building hereafter erected, altered or moved and/or prior to the change of use of any building or land.
   (B)   A watershed protection occupancy permit, either for the whole or part of a building, shall be applied for coincident with the application for a watershed protection permit and shall be issued or denied within ten days after the erection or structural alterations of the building. The building must have received approval by the Building Inspector for compliance with the North Carolina State Building Code prior to issuance of the watershed protection occupancy permit.
   (C)   When only a change in use of land or existing building occurs, the Watershed Administrator or his or her designee shall issue a watershed protection occupancy permit certifying that all requirements of this chapter have been met coincident with the watershed protection permit.
   (D)   No building or structure which has been erected, moved or structurally altered may be occupied until the Administrator has approved and issued a watershed protection permit.
