In cases where multi-family developments are developed with the intent for sale of single living units, the following additional requirements shall apply.
(A) A letter shall accompany the approval request stating that the units will be offered for sale rather than as rental property.
(B) All collector and local streets shall be dedicated to public use and paved within 30 days of the sale of the last unit or lot.
(C) A property owner’s association or other similar body shall be created. It will be charged with the responsibility for maintenance of the common property and it shall have the power to levy liens against individual property owners. All property owners shall be members of this association. In large scale development, more than one property owner’s association may be created.
(D) Condominiums must comply with G.S. Chapter 47A, Unit Ownership Act.
(E) Any subdivision of land shall conform to Chapter 155 of this code.
(F) A final plan shall be submitted for approval by the Planning Board and the County Board of Commissioners.
(G) Upon approval of the final plan, it shall be recorded with the County Register of Deeds.
