§ 112.01  DEFINITIONS.
   The following words and phrases shall have the following definitions when used in this chapter:
   APPLICATION. An application for a permit under this section and includes all supplemental documentation attached or required to be attached thereto; the person filing the application shall be known as the APPLICANT.
   AVAILABLE PERMIT. A permit that may be issued by the township without exceeding the maximum number of permits according to § 112.02(B). A permit currently in effect and available for renewal shall not be considered an available permit unless a renewal application has not been filed or granted as required by this chapter.
   COMMERCIAL MEDICAL MARIHUANA FACILITY OR FACILITY. One of the following:
      (1)   PROVISIONING CENTER. As that term is defined in the Medical Marihuana Facilities Licensing Act, Public Act 281 of 2016 (MMFLA);
      (2)   PROCESSOR as that term is defined in the MMFLA;
      (3)   SECURE TRANSPORTER, as that term in the MMFLA;
      (4)   GROWER including Class A, Class B and Class C, as those terms are defined in the MMFLA; and
      (5)   SAFETY COMPLIANCE FACILITY as that term is defined in the MMFLA.
   DEPARTMENT. The Michigan State Department of Licensing and Regulatory Affairs or any authorized designated Michigan agency authorized to regulate, issue or administer a Michigan License for a commercial medical marihuana facility.
   LICENSE. A current and valid license for a commercial medical marihuana facility issued by the State of Michigan.
   LICENSEE. A person holding a current and valid Michigan license for a commercial medical marihuana facility.
   MARIHUANA. That term as defined in Section 7106 of the Michigan Public Health Code, 1978 PA 368, M.C.L.A. 333.7106.
   MEDICAL MARIHUANA. That term as defined in M.C.L.A. 333.26423.
   PARAPHERNALIA. Drug paraphernalia as defined in Section 7451 of the Michigan Public Health Code, 1978 PA .368, M.C.L.A. 333.7451, that is or may be used in association with Medical Marihuana.
   PATIENT. A "registered qualifying patient" or a "visiting qualifying patient" as those terms are defined by M.C.L.A. 333.26421 et seq.
   PERMIT. A current and valid permit for a commercial medical marihuana facility issued under this chapter, which shall be granted to a permit holder only for and limited to a specific permitted premises and a specific permitted property. Said permit shall be in addition to the special use permit required to be obtained under the Township Zoning Ordinance.
   PERMIT HOLDER. The person that holds a current and valid permit issued under this chapter.
   PERMITTED PREMISES. The particular building or buildings within which the permit holder will be authorized to conduct the facility's activities pursuant to the permit.
   PERMITTED PROPERTY. The real property comprised of a lot, parcel or other designated unit of real property upon which the permitted premises is situated.
   PERSON. A natural person, company, partnership, profit or non-profit corporation, limited liability company, or any joint venture for a common purpose.
   PRIMARY CAREGIVER. A person qualified under M.C.L.A. 333.26423(g), and the rules promulgated therefore by the Department of Community Health, Rule 333.101 et seq., including, but not limited to possession of a valid, unexpired registry identification card, to assist with a patient's medical use of marihuana, and authorized under the Michigan Medical Marihuana Act (MMMA) to operate as a primary caregiver.
   PRIMARY CAREGIVER OPERATION. A location where a primary caregiver can lawfully operate as permitted by the MMMA and this chapter. A primary caregiver operation is not a commercial medical marihuana facility.
   PUBLIC PLACE. Any area in which the public is invited or generally permitted in the usual course of business.
   REGISTRY IDENTIFICATION CARD. The document issued to a patient or a primary caregiver and defined under M.C.L.A. 333.26423(i).
   REVIEW BOARD. The Parma Township Commercial Medical Marihuana Facilities Review Board as established by the Parma Township Commercial Medical Marihuana Review Board Ordinance.
   VALID INSURANCE POLICY. A commercial general liability insurance policy satisfactory to the Township Board.
