(A) Purpose. This section is adopted for the purpose of providing for the payment of outside contractors who provide assistance to the Fire Department during and/or subsequent to a structure fire or other emergency situation within the township.
(B) Definitions. For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
BOARD. The Township Board of Trustees as a whole.
OUTSIDE CONTRACTOR. Any individual, partnership, company or corporation with the equipment and expertise to provide a service, for a fair and equitable fee, that is beyond the normal scope of the Fire Department. The need for such services will be at the sole discretion of the Fire Chief or his or her designee.
TOWNSHIP. Parma Township.
(C) Fees. In the event that the Fire Chief or his or her designee determines that the Fire Department needs to utilize the services of an outside contractor, during and/or subsequent to a structure fire or other emergency situation, the township has the responsibility and full right to charge the property owner the entire amount of the contractor’s invoice. The contractor’s fee is expected to be fair and equitable for the services rendered. These fees cannot by law be charged as a lien against the property.
(D) Payment. The aforementioned fee shall be due and payable within 30 days from the date of the township’s invoice to the property owner and in default of payment shall be collectible through proceedings in district court of competent jurisdiction as a mature debt. If extenuating circumstances arise, the property owner may appeal to the Board for an extension of the terms set forth in this section.
(E) Collection of fees. The township may proceed in district court by suit to collect any monies unpaid and shall have any and all other remedies provided by law for the collection of said fees.
