(A) Appeals of any decision made by the hearing officer will be filed in Hubbard County District Court, Ninth Judicial District of Minnesota.
(B) If the hearing officer has kept a verbatim written record of the proceeding, including an audio or video tape record which is capable of transcription, then the appeal to the District Court will be limited to a review of the record.
(C) If the hearing officer has failed to keep a record of the proceeding, then any appeal to the District Court will be heard by the District Court de novo.
