Failure to protect groundwater. An SSTS that is determined not to be protective of groundwater in accordance with Minnesota Rules, Chapter 7080.1500, Subd. 4B shall be upgraded, repaired, replaced or abandoned by the owner in accordance with the provisions of this chapter within 12 months of receipt of a Notice of Noncompliance.
(A) Imminent threat to public health or safety.
(1) An SSTS that is determined to be an imminent threat to public health or safety in accordance with Minnesota Rules, Chapter 7080.1500, Subd. 4A shall be upgraded, repaired, replaced or abandoned by the owner in accordance with the provisions of this chapter within 10 months of receipt of a Notice of Noncompliance.
(2) An SSTS posing an imminent threat to public health or safety shall be pumped within 24 hours of the determination that the SSTS is an imminent threat and managed as a holding tank if the tank is sealed and compliant until an SSTS upgrade is completed. If the tank is not compliant or able to function as a holding tank, the building(s) serviced by the SSTS shall not be occupied or inhabited per § 153.016 of this chapter until an SSTS upgrade is completed or unless a Department approved alternative for safe waste disposal is implemented.
(B) Abandonment. Any SSTS, or any component thereof, which is no longer intended to be used, must be abandoned in accordance with Minnesota Rules, Chapter 7080.2500.
