Any vendor offering for sale sparklers, novelties and/or any other items as defined in West Virginia Code 29-3-23, shall be subject to the following regulations:
(a) No such items shall be offered for sale within 300 feet of the property line of a church, hospital or school;
(b) No such items shall be offered for sale within fifty feet of the property line upon which any flammable liquid dispensers or flammable liquid storage areas are located;
(c) No such items shall be offered for sale within fifty feet from the property line of any building occupied as a residence, place of business, or occupied for any other purpose;
(d) No such items shall be offered for sale within thirty feet of the closest boundary line of any public street;
(e) Any vendor offering such items for sale shall provide pressurized water fire extinguishers with a minimum classification of 2A; provided, however, that in the absence of any such fire extinguisher a garden hose, connected to an adequate water supply, may be substituted;
(f) Any vendor offering such items for sale must provide two remotely located exits, which shall at all times be unobstructed;
(g) Any vendor offering such items for sale shall maintain their property free of all weeds, dried grass and combustible materials for a minimum distance of twenty- five feet in any direction from the outer edge of any building or structure within which such items are offered for sale;
(h) All electric wiring within or in the immediate proximity of any building or structure within which such items are offered for sale must comply with the National Electrical Code;
(i) No vendor offering such items for sale shall permit any open flame devices within twenty-five feet of any building or structure within which such items are offered for sale;
(j) All items defined in West Virginia Code 29-3-23 offered for sale by any vendor shall be located within the vendor’s place of business behind a counter or other obstruction in such a manner that any person seeking to view or purchase any such items must obtain them from the vendor or his employee, and such items must be displayed in a manner so as to prevent direct access by any person to such items without first having obtained permission from vendor or vendor’s employee;
(k) A minimum of two exits shall be required and shall be in compliance with the West Virginia State Fire Codes;
(l) All tents used by outdoor vendors shall comply with NFPA 701 (Flame-Resistant Textiles and Films);
(m) All other provisions of any West Virginia State Fire Code and the NFPA Life Safety Code shall be met.
