Pursuant to the provisions of West Virginia Code Chapter 8, Article 16, Section 4, the custody, administration, operation, maintenance, supervision and control of the floodwalls and floodwall systems of the City, including the properties and appurtenances thereto shall be under the supervision and control of the governing body of the City as that term is defined in West Virginia Code Chapter 8, Article 1, Section 2(b)(1).
Accordingly, the administrative functions relating to the custody, administration, operation, maintenance, supervision and control of the floodwalls and floodwall systems of the City shall be vested in the Mayor and the Director of Public Works.
All legislative functions relating to the floodwalls and floodwall systems of the City, including but not limited to the adoption of a budget allocating the revenues and appropriating the expenditures for the operation of said floodwalls and floodwall systems shall be vested in City Council.
