1-5-7: COUNCIL PROCEDURE:
   A.   Meetings:
      1.   Regular Meetings 1 : The council shall hold regular meetings on the first and third Tuesdays of each month at six o'clock (6:00) P.M.; provided, that when the day fixed for any regular meeting of the council falls upon a day designated by law as a legal holiday, such meeting shall be held at the same hour on the next succeeding day not a holiday. All regular meetings of the council shall be held in the town hall or other designated meeting place. The council may, by motion, cancel or reschedule any meeting. Notice of a change of any meeting place, date or time shall be given as required by law. (Ord. 01-2007, 2-6-2007; amd. Ord. 10-2009, 8-26-2009)
      2.   Special Meetings: The mayor, vice mayor, or any three (3) council members may convene the council at any time after giving at least twenty four (24) hours' written notice of such meeting to members of the council and the general public. The notice shall include the date, hour and purpose of such special meeting. In the case of an actual emergency, a meeting may be held upon such notice as is appropriate to the circumstances.       3.   Open To Public 2 : All proceedings of the council shall be open to the public; except, that upon approval by a majority vote of the council, the council may meet in a closed executive session pursuant to the provisions of state law. (1988 Code § 2-4-3)
   B.   Quorum 3 : A majority of the council members shall constitute a quorum for transacting business, but a lesser number may adjourn from time to time and compel the attendance of absent members. No such adjournment shall be to a day beyond the next stated meeting of the council. (1988 Code § 2-4-4; amd. 2004 Code)
   C.   Agenda: Prior to each council meeting, or on or before a time fixed by the council for preparation and distribution of an agenda, whichever is earlier, the manager shall collect all written reports, communications, ordinances, resolutions, contracts and other documents to be submitted to the council, prepare an agenda according to the order of business and furnish each council member, the mayor and the attorney with a copy.    D.   Order Of Business; Procedures For Meetings 4 :
      1.   The mayor or the vice mayor or acting mayor, in consultation with the town manager, shall set the agenda and order of the meeting pursuant to state law. Council members may submit agenda items to the manager for consideration by the council. Such items shall be submitted in time for preparation of the agenda.
      2.   The mayor shall take the chair precisely at the hour appointed for the meeting and shall immediately call the council to order. In the absence of the mayor, the vice mayor shall call the council to order. In the absence of both the mayor and vice mayor, the clerk shall call the council to order and an acting mayor shall be selected to chair the meeting. Upon the arrival of the mayor or the vice mayor, the vice mayor or the acting mayor shall immediately relinquish the chair upon the conclusion of the business immediately before the council. The mayor shall preserve order and decorum, decide all questions of order and conduct the proceedings of the meetings in accordance with the parliamentary rules contained in "Robert's Rules Of Order".       3.   Petitions, remonstrances, communications and comments or suggestions from citizens present may be heard by the council during "call to the public". All such remarks shall be addressed to the council as a whole, and not to any member thereof. Such remarks shall be limited to three (3) minutes, unless additional time is granted by the council. No person other than the individual speaking shall enter into the discussion without the permission of the presiding officer. No question shall be asked a council member during "call to the public".    E.   Committees And Commissions: The council may create such boards, committees and commissions, standing or special, as it deems necessary. They shall consist of as many members and shall perform such duties as the council may require and shall exist at the pleasure of the council. (1988 Code § 2-4-7)
   F.   Voting:
      1.   The mayor shall vote as a member of the council.
      2.   Upon the request of any member, the ayes and nays upon any question shall be taken and entered in the minutes. (1988 Code § 2-4-8)
   G.   Suspension Of Rules: Any of the provisions of this section may be temporarily suspended in connection with any matter under consideration by a recorded vote of not less than three-fourths (3/4) of the members present; except, that this subsection shall not be construed to permit any action that is contrary to state statutes. (1988 Code § 2-4-9)
   H.   Consent Agenda: Whereas many items of business require action by the town council, but are themselves of a routine and noncontroversial nature, and it is desirable to expedite the transaction of public business and provide additional time for the deliberation of nonroutine matters, a consent agenda may be utilized as follows:
      1.   When any item of business requires action by the council, but is of a routine and noncontroversial nature, such item may be presented at a regular meeting of the council as a part of the consent agenda.
      2.   The consent agenda shall be introduced by a "motion to approve the consent agenda", and such agenda and each item thereon shall be considered by the council as a single item.
      3.   There shall be no debate or discussion by any member of the council regarding any item on the consent agenda, beyond the asking of questions for purposes of clarification.
      4.   All items on the consent agenda which require public hearings shall be open for hearing simultaneously, and prior to the vote upon the motion to approve the consent agenda, and the mayor shall announce the titles of all such hearing items.
      5.   Upon objection by any member of the council to the inclusion of any item on the consent agenda, that item shall be removed from the consent agenda forthwith. Such objections may be made and recorded at any time prior to the taking of a vote upon the consent agenda. All such items shall be considered individually, in the order to which they were objected, immediately following the council's consideration of the consent agenda.
      6.   Approval of the motion to approve the consent agenda shall be the full equivalent to the approval, adoption or enactment of each motion, resolution, ordinance or any other item of business thereon, exactly as if each such item had been acted upon individually. (1988 Code § 2-4-10)
