§ 74.007 BASIS FOR ESTABLISHING THE SPECIAL FLOOD HAZARD AREAS AND CONSERVATION DISTRICTS
   (A)   The areas of special flood hazard identified by the Federal Emergency Management Agency (FEMA) in the flood insurance study (FIS) for Bourbon County and incorporated areas, dated January 6, 2011, with the accompanying flood insurance rate maps (FIRMs), other supporting data and any subsequent amendments thereto, are hereby adopted by reference and declared to be a part of these regulations by Paris, and for those land areas acquired by Paris through annexation. This FIS and attendant mapping is the minimum area of applicability of this chapter and may be supplemented by studies for other areas which allow implementation of this chapter and which are recommended to the City Commission by the Floodplain Administrator and are enacted by City Commission pursuant to statutes governing land use management regulations. The FIS and/or FIRM are permanent records of Paris and are on file and available for review by the public during regular business hours at Paris City Hall at 525 High Street, Paris, Kentucky, 40361.
   (B)   There are areas in Bourbon County where detailed hydrologic and hydraulic calculations may not have been performed. In these areas, a soils floodplain may be used to establish approximate floodplain boundaries. The soils floodplain consists of the alluvial soils listed below as defined by the U.S. Department of Agriculture Natural Resources Conservation Service:
      (1)   Dunning Silty Clay Loam - Du;
      (2)   Lawrence Silt Loam - La;
      (3)   Lindside Silt Loam - Ln;
      (4)   Newark Silt Loam - Ne; and
      (5)   Nolin Silt Loam - No.
   (C)   Some soils floodplains exist along streams that have a FEMA floodplain or post-development floodplain where detailed hydrologic and hydraulic calculations have been performed. In this case, the FEMA floodplain and post development floodplain shall take precedence over the soils floodplain.
   (D)   Some soils floodplains exist along streams or low-lying areas that do not have a FEMA floodplain or post-development floodplain and where detailed hydrologic and hydraulic calculations have not been performed. In this case a structure can be constructed in the soils if:
      (1)   The property owner provides hydrologic and hydraulic calculations from a professional engineer licensed in Kentucky, proving that the proposed structure will not flood for the 100-year storm, will not create a drainage problem.
      (2)   A foundation design stamped by a professional engineer licensed in Kentucky, is submitted as part of the applications for a building permit.
