§ 53.01 RATES AND CHARGES.
   (A)   There shall be and there is hereby established for the use of, and the service rendered by the waterworks system of the town the following schedule of rates and charges, based upon the use of water supplied by the waterworks system.
   (B)   The rates herein approved shall provide for a reasonable return on the water utility plant of the town and such other legal and necessary expenses as provided in I.C. 8-1.5-3-8.
   (C)   The Town Council hereby elects to pay the town, from water rates and charges, payment in lieu of property taxes as provided in I.C. 8-1.5-3-8.
   (D)   Schedule of rates and charges.

      (5)   Late payment charge. All bills for water service or for public or private fire protection, including sprinklers, not paid within ten days after the bill is mailed shall be subject to a late payment charge of 10% of the first $3.00 and 3% of the excess of $3.00.
      (6)   Connection charges. The minimum charge for connecting to the Municipal Waterworks shall be as follows, payable at the time application for connection is made:

      (7)   Disconnection charge.
         (a)   When the service is turned off by the town for nonpayment of the customer’s account, or for any other justifiable reason, a disconnection fee of $30 shall be charged to that customer by the town to cover the cost of disconnection of service.
         (b)   When the service is turned off for temporary disconnection to a customer’s account, no disconnection charge will be assessed to the customer, but the town will continue to bill the minimum monthly water charge during the temporary disconnection period.
      (8)   Reconnection charge.
         (a)   When the service is turned off by the town for nonpayment of the customer’s account, or for any other justifiable reason, and a reconnection of service is requested by the customer, a minimum charge of $30 shall be charged to that customer by the town to cover the cost of reconnection of service.
         (b)   If the reconnection occurs after hours, an additional fee of $60 will be charged. The charges, together with any delinquent amounts due the town and any security deposit required by the town, shall be paid by the customer in full before service will be reconnected.
         (c)   In the event of a temporary disconnect taking place, when the customer requests a reconnection of service, no fee will be assessed.
      (9)   Deposit. Each user shall pay a deposit of $100, which shall be returned upon discontinuance of service, after deduction of any unpaid bill for utility services.
      (10)   Dishonored checks. Any check issued by the customer that is returned for non-sufficient funds or account closed will be required to pay a charge of $20. All returned checks must be redeemed by cash, a cashier’s check, a certified check or a money order. The customer will be put on a cash-only list and will not be allowed to write a check for six months.
      (11)   Temporary users. Water furnished to temporary users, such as, but not limited to, contractors, fairs, circuses and the like, shall be charged for the basis of the above quantity rates as estimated by the Waterworks Superintendent.
      (12)   Free service. No free service of the water system shall be permitted. Each residence, each commercial establishment and each industry shall by individually metered.
