§ 50.16 DEFICIENCY POLICY.
   (A)   Deficiencies. The Town Electric Department may issue a deficiency notice to any town resident whose service does not meet the requirements of state law, federal law, any town policy and/or ordinance, or any service that poses a safety threat/hazard. It shall be the responsibility of the Electric Foreman of the town to determine whether a deficiency exists.
   (B)   Deficiency notice. A notice of deficiency (the “notice”) will be sent by the Town Clerk-Treasurer to any town resident that is found in violation of this section. The notice will list any and all deficiencies that need to be corrected and the amount of time the violator has to correct said deficiencies. The amount of time to correct deficiencies will be determined by the Electric Foreman of the town and will be dependent on the safety threat of the deficiency.
   (C)   Penalties.  
      (1)   A disconnection of service may occur if a person is found in violation of division (A) or (B) of this section and fails to correct the deficiency in the amount of time specified in the notice.
      (2)   An immediate disconnection may occur if the Electric Foreman of the town determines that a resident’s deficiency poses a severe and immediate risk to the public or property owner.
