(a) Action by Commission. The Commission may take final action on an application prior to the preparation of the written decision, but in such event the Commission, before taking such action, shall first state its findings and conclusions at a meeting open to the public. The Commission's decision shall be deemed made as of the date of the taking of such final action. The written decision incorporating such findings and conclusions shall be presented and approved at the next regular meeting of the Commission open to the public. The final action, including the minutes of the meeting at which the Commission's findings and conclusions were made, may be forwarded to the Council for consideration prior to the completion of the written decision.
(b) Written Decisions. Every decision of the Commission on an application shall be in writing and shall include findings of fact; shall refer to all the evidence in the record and to the exhibits, plans, or specifications on which the decision is based; shall specify the reason or reasons for the decision; and shall contain a conclusion or statement specifically setting forth the decision of the Commission and any limitations or conditions recommended or imposed by the Commission. The written decision shall be forwarded to the Council promptly after it is approved.
(c) Failure to Act. When this title provides that the failure of the Commission to act within a fixed period of time shall be deemed a recommendation to approve or deny an application, that recommendation shall be deemed to have been made on the day after the expiration of that fixed period of time, notwithstanding the absence of required findings and conclusions.
