(a) It shall be unlawful for any person to erect, install or maintain any commercial variable message sign or flashing sign within the Village.
(b) All signs described in subsection (a) hereof already in existence as of October 10, 2005, shall be considered legal, non-conforming signs, and may still be operated, except as restricted by the five-year sunset provision in subsection (c) hereof; and the following public safety criteria, which are effective immediately upon this section's effective date:
(1) Length of cycle: The total length of each message and/or image in the information cycle of a legal, non-conforming sign as described in this section shall be at least seven seconds in length.
(2) Brightness adjustment: In no instance shall the lighting intensity of a legal, non- conforming sign as defined in this section, whether resulting from internal illumination or external illumination, exceed 5000 nits from dawn to dusk, and 2500 nits from dusk to dawn. In addition, the glare from any such legal, non-conforming sign shall not project onto any adjacent properties or rights-of-way.
(c) Sunset Provision. Any legal, non-conforming sign as described in this section which does not conform to the provisions of subsection (a) hereof shall be removed, or made to conform to said provision, within five years of the date of written notification by the Village that the sign does not conform to the requirements of subsection (a) hereof. Any previously existing, legal non-conforming sign as defined in this section that is operated in a manner that complies with all requirements of any applicable Village Code provisions after this sunset provision takes effect shall be considered to be in compliance with the requirements of subsection (a) hereof and does not have to be removed, even though technically capable of being operated as a flashing sign or commercial variable message sign.
