1480.12 TEMPORARY SIGNS.
   (a)   Permitted Types of Temporary Signs and Regulations Relative Thereto.
      (1)   Temporary signs inside building windows; provided, however, no more than fifty percent (50%) of the surface area of the window may be covered by temporary signs.
      (2)   Flags, banners, and party balloons attached to buildings, provided they do not extend above the building wall, and do not extend more than five feet out from the building wall.
      (3)   Temporary signs that sit on the walkway or ground between the building and the parking lot, with each sign face to be eight square feet or less, provided they are not illuminated.
      (4)   Balloon figures, provided they conform to the following standards:
         A.   In the form of an animal or cartoon character or similar shape;
         B.   Not illuminated;
         C.   Setback at least three feet from all property lines;
         D.   Limited to one per property at a time; and
         E.   Limited to being located on the property for no more than five consecutive days at a time, with not less than three months between the use thereof on the property.
      (5)   Free-standing, temporary ground signs, other than the temporary signs described in subsections (3) and (4) above, provided they conform to the following standards:
         A.   May be internally illuminated;
         B.   No flashing or moving lights;
         C.   Each temporary sign face shall not exceed thirty-two square feet;
         D.   The height of the temporary sign shall not exceed five feet above curb or grade at base of the temporary sign, whichever is higher;
         E.   The temporary sign shall be located at least three feet behind all property lines;
         F.   The temporary sign shall be separated from other permanent and temporary signs by at least fifty feet; and
         G.   Not more than two temporary signs per property frontage shall be allowed at the same time, for not more than four weeks at a time, with not less than four months between the use thereof on the property.
         H.   Notwithstanding subsection G. above, due to the reconstruction and widening of LaGrange Road, businesses located from 12828 South LaGrange Road South to the Village limits, and from 9664 West 131st Street East to 9520 West 131st Street (the "construction limits"), shall be allowed to have one temporary sign per property, or shopping center, that states "open during construction," without need to obtain a permit therefor. In addition to the foregoing, any business within the construction limits that desires to place a temporary sign advertising the business along, but not within, the rights-of-way of either LaGrange Road or 131st Street, shall file a permit application with the Village, and shall pay a twenty-five dollar ($25.00) permit fee with the application. The applicant shall be allowed to rollover the fee to its next temporary sign application, or have the fee returned, at the end of the initial temporary sign permit period. Limitations on such temporary signage shall be as follows:
            1.   Single business tenant properties shall be allowed to have not more than two temporary signs per property at the same time, with each sign to be posted for not more than four weeks at a time (the "posting period"), with not less than a one-month period between the posting period and the next posting period for the same temporary sign.
            2.   Multiple business tenant properties shall be allowed to have not more than six temporary signs per property at the same time, with each sign to be posted not more than four weeks at a time (the "posting period"), with not less than a one-month period between the posting period and the next posting period for the same temporary sign.
            The provisions of this subsection shall be in full force and effect only through January 1, 2018, at which time they shall be repealed, and of no further force or effect, without need for further action by the Village Council.
      (6)   Signs as described in subsections (4) and (5) above shall be subject to Village permits and shall be removed when the permit expires.
      (7)   Temporary signs shall:
         A.   Have no moving parts;
         B.   Not be carried by a person or animal;
         C.   Not block the view of, or access to, a door, fire hydrant, other permanent or temporary sign, sidewalk, parking area, or block the view of, or distract the attention of those driving on the property or on the street;
         D.   Be securely attached, anchored, and otherwise designed to be wind resistant and fire safe;
         E.   Not be attached to trees or utility posts;
         F.   Be kept in a clean, safe and sanitary condition, with rust, graffiti, and peeling paint being removed or covered up in a timely manner; and
         G.   If damaged, be repaired or removed in a timely manner.
   (b)   Fees. Anyone wishing to place a temporary sign shall file a permit application with the Village and shall pay a twenty-five dollar ($25.00) permit fee with the application. Notwithstanding the foregoing, there shall be no fee for those temporary signs as described in subsections (a)(1), (2), and (3) above.
