(a) Generally. No person shall erect, move or substantially improve a structure, or fill or excavate a parcel of land, within the Village, without first obtaining a grading permit or a waiver of such requirement. All applications for grading permits shall be accompanied by a fee of five hundred dollars ($500.00). If it is determined by the Building Department that a grading permit is not required, the fee shall be refunded.
If it is determined that a grading permit is required, the fee for said permit shall be one hundred dollars ($100.00) plus the actual costs incurred by the Village in using independent contractor consultants to review the grading permit application, which amount shall be deducted from the five hundred dollars ($500.00) which accompanied the permit application. Should said permit fee be less
than five hundred dollars ($500.00), the balance on deposit will be returned to the applicant along with the grading permit. Should said permit fee exceed said five hundred dollar ($500.00) amount, no grading permit shall issue until the applicant has paid the balance due.
(b) Exceptions. A grading permit may not be required on certain improvements under the following classifications, as determined by the Building Commissioner:
Any changes to an existing structure, including additions or alterations to an existing structure, that do not affect storm water drainage to the parcel in question or do not affect storm water drainage to adjoining property, unless the Building Commissioner finds to the contrary.
(c) Issuance and Administration.
(1) The Building Commissioner will be responsible for issuance of all grading permits and for the administration of this chapter. Every grading permit shall expire by limitation and shall become null and void if the work authorized by such permit has not begun within ninety days from the date of issuance thereof. In the case of such expiration and cancellation, the Commissioner shall provide written notice thereof to their permittee.
(2) If the work described in the grading permit has not been substantially completed within one year of the date of issuance thereof, such permit shall be expired and canceled by the Commissioner and written notice thereof shall be given to the permittee, together with a notice that further work is prohibited. No work shall proceed on the canceled permit until a special grading permit has been issued by the Village.
(3) At the discretion of the Commissioner, such special grading permit may be issued based on the original application and permit, or the Commissioner may require submission of a new application. The special grading permit may include limitations on time allowed for substantial completion of the work. All special grading permits shall be accompanied by a reasonable performance bond in an amount and form satisfactory to the Village. The performance bond shall provide surety for the completion of the improvements covered by the permit, within the time limit set by the Commissioner.
