1461.03 REVIEW PROCESS.
   The review process to be followed by the Plan Commission and Village Council, as referenced in and required by Section 1461.02, shall be as follows:
   (a)   The Plan Commission review process shall be triggered by an application for commercial development construction and landscaping criteria approval. Such application shall be submitted to the Village Clerk and shall include a set of certified plans providing sufficient detail to allow the Plan Commission to review said plans and make a determination as to whether the proposed construction and/or landscaping is in compliance with the criteria set forth in Section 1461.01. Said plans shall include detail relative to all building features regulated by this Chapter; a colored rendering of all sides of the building and structures indicating materials used; all signage; all exterior lighting, including fixture cuts and a light spread chart; and all landscaping. The application and plan submittal shall consist of one original and ten copies.
   (b)   Upon receipt of an application for commercial development construction and landscaping criteria approval, the Village Clerk shall forward the application to the Chairperson of the Plan Commission, who shall in turn have the application placed on the agenda of a regular or special meeting of the Plan Commission within forty-five days of the filing of the application. Prior to the Plan Commission's meeting at which the application and plans are considered, the Village administrative staff shall prepare a report to the Plan Commission, analyzing the compliance of the application and plan with the criteria set forth in Section 1461.01.
   (c)   If a majority of those members of the Plan Commission present at the meeting at which the application and plans are reviewed determine, by a vote of said members, that the application and plans submitted are in compliance with all of the commercial construction and landscape criteria set forth in Section 1461.01, the Commission shall issue a written recommendation to the Village Council that the application and plans be approved. If a majority of those members of the Plan Commission present at the meeting at which the application and plans are reviewed determine, by a vote of said members, that one or more of the applicable criteria have not been met, the applicant shall have the option of either: (1) continuing the matter before the Plan Commission to a future meeting and revising the application and plans to address the item(s) of noncompliance; or (2) requesting that a written recommendation of the Plan Commission's decision be made to the Village Council to be considered at the next regular meeting of the Village Council.
   (d)   The Village Council shall consider the recommendation of the Plan Commission at the first regular meeting of the Village Council following receipt of the Plan Commission's recommendation. If a majority of those members of the Village Council present at the meeting at which the application, plans and Plan Commission recommendation are reviewed determine, by a vote of said members, that the application and plans submitted are in compliance with all of the commercial construction and landscape criteria set forth in Section 1461.01, the application and plans shall be deemed approved and a written certificate of compliance evidencing such approval shall be forwarded to the Building Department. If a majority of those members of the Village Council present at the meeting at which the application, plans and Plan Commission recommendation are reviewed determine, by a vote of said members, that one or more of the applicable criteria have not been met, the applicant shall have the option of continuing the matter to a future Council meeting and revising the application and plans to address the item(s) of noncompliance; otherwise, the application and plans shall be deemed rejected and no building permit shall be issued.
