1242.05 VARIANCES.
   (a)   In General. The Plan Commission may recommend variances from the literal application of the design standards specified in these Subdivision Regulations:
      (1)   Where conformity with such standards is made impossible by topography or surrounding development;
      (2)   Where an existing plat is to be re-platted in a manner which more nearly complies with these Regulations than the existing plat; or
      (3)   Where the proposed subdivision does not follow the conventional system of development of lots, blocks or streets.
   (b)   Conditions. In recommending any variance, the Plan Commission shall specify conditions necessary to ensure that the proposed subdivision:
      (1)   Will not be detrimental to the neighborhood and to the community as a whole;
      (2)   Complies with the Comprehensive Plan of the Village;
      (3)   Complies with the intent of these Regulations; and
      (4)   Does not violate any other ordinance or regulation of the Village.
   (c)   Review of Application and Notice. All requests for subdivision variances shall be reviewed by Village staff for completeness, and then forwarded in a timely manner to the Plan Commission, who shall consider said request at a public hearing, and make recommendations to the applicant and to the Village Council, who shall approve or deny said request. The notices and public hearing procedures shall conform to Section 1262.10 of the Village Code.
