1046.32 ESTABLISHMENT OF RATES AND CHARGES.
   All consumers of water supplied by the Village shall pay for such service according to the following schedule:
   (a)   Customer Rates for General Water Use. All customers shall pay thirteen dollars and fifty cents ($13.50) per 1,000 gallons of water supplied by the Village. In addition to the foregoing water consumption rate, a water system capital improvements fee of six dollars and fifty cents ($6.50) per month shall be charged to each water account.
   (b)   Minimum Charges. All customers shall pay a minimum monthly water usage charge (inclusive of the water system capital improvements fee referenced in subsection (a) above), of forty-seven dollars ($47.00) per month. Notwithstanding the foregoing, during any month in which the lawn irrigation system for a planned unit development or a commercial property has been shut down for the entire month, a single minimum monthly charge shall be assessed relative to said lawn irrigation system, even if more than one water meter is used to service said lawn irrigation system.
   (c)   Water Supply Charges. Water supply charges are contained in water agreements with specific groups of customers, but in accordance with the rates contained in this section.
   (d)   Customer Rates for Fire Line. Where an unmetered connection to the Village water supply system is made, with the Village's permission, solely for the purpose of supplying water to a fire suppression system within a building (hereinafter referred to as a "fire line"), the monthly charge for said fire line shall be as set forth below, based on the size of the pipe used for said fire line:

   (e)   Deposits. In addition to the rates and charges provided for in this section, each user shall be required to have on deposit an amount sufficient to pay water charges for one billing cycle, as estimated by the Village. This shall be the equivalent of one month's or one quarter's usage, depending upon the frequency of the billing cycle.
   (f)   Shut-Off Charge. If for any reason it becomes necessary to shut off individual water service, there shall be assessed a charge of one hundred dollars ($100.00), which shall be immediately payable, but in no event shall it be paid later than the reinstallation of water service.
   (g)   Water Connection Charges. The water connection fees are hereby established as follows:
      (1)   Connection fee (per single-family residence).

         A.   Area #1 (East): That portion of the Village located east of LaGrange Road (96th Avenue), except that portion thereof bounded by LaGrange Road (96th Avenue) on the west, 127th Street on the north, 92nd Avenue on the east and 131st Street on the south.
         B.   Area #2 (Central): That portion of the Village located between 102nd Avenue on the west and LaGrange Road (96th Avenue) on the east, along with that portion of the Village bounded by LaGrange Road (96th Avenue) on the west, 127th Street on the north, 92nd Avenue on the east and 131st Street on the south.
         C.   Area #3 (West): That portion of the Village located west of 102nd Avenue.
      (2)   Connection fee (multifamily residential/planned unit developments). One fourth of the applicable connection fee for a single-family residence, as set forth in subsection (g)(1) above, per dwelling unit.
      (3)   Connection fee (commercial/industrial):
         A.   Where the commercial/industrial use is not a food service/preparation use or a use which processes water, and the average water usage is not anticipated to exceed 7,500 gallons per month, the connection fee shall be the same as for a single-family residence, as set forth in subsection (g)(1) above.
         B.   Where the commercial/industrial use is not a food service/preparation use or a use which processes water, and the average water usage is anticipated to exceed 7,500 gallons per month, but not be more than 11,250 gallons per month, the connection fee shall be based upon the following formula:

         C.   For all commercial/industrial uses which are not covered by either subsection (g)(3)A. or B. above, the connection fee shall be one and one-half times the applicable connection fee for a single-family residence, as set forth in subsection (g)(1) above.
      (4)   While it is the intent of the Village Council to review the foregoing connection fees during the first quarter of 2021, in the event the Village Council fails to do so, the connection fees that will go into effect on May 1, 2021 shall equal one hundred one percent of the connection fees in effect on April 30, 2021 (rounded to the nearest dollar amount), with an additional one percent increase in the connection fees (based on the previous year’s connection fees) going into effect each May 1st thereafter (rounded to the nearest whole dollar amount), until such time as this subsection (g) is further amended.
      (5)   The connection fees provided for by this subsection shall not include the cost of extending the Village’s water system to service any development, which cost shall be the responsibility of the developer. Notwithstanding the foregoing, upon approval by the Village Council, the Village may accept a donation of construction, expansion or extension of the Village’s water system in lieu of all or part of the connection fees established by this section.
      (6)   For purposes of subsection (g)(3) above, a commercial/industrial use shall be deemed to “process water” if the use of water is for other than the normal uses of water by a single-family residence (i.e. bathroom, basic cleaning, domestic kitchen use, watering of plants/grass, etc.). In the event that a question arises as to whether a commercial/industrial use “processes water,” the Commissioner of Public Works shall make the final determination.
      (7)   In the event that a property owner is unable to pay the connection fee, as referenced in subsection (1) above, in one lump sum payment, said property owner can pay said connection fee over up to a ten (10) year period. If a property owner chooses to pay the connection fee other than in one lump sum, an initial payment, equal to at least ten percent (10%) of the amount of the connection fee, shall be made by said property owner, with the remainder of the connection fee being paid pursuant to bi-monthly payments as part of the bi-monthly water and sanitary sewer bill, with simple interest on the unpaid balance accruing at a rate of six percent (6%) per annum until the entire connection fee is paid. Failure to make any bi-monthly connection fee payment, including any interest payment, shall subject the non-paying party to the billing penalty and discontinuation of service provisions of Sections 1046.35 and 1050.01. Where a property owner chooses to pay the connection fee other than in a lump sum payment, a lien shall be recorded against said property owner's property to evidence the connection fee that is owed, as well as the payment terms. The cost for recording and releasing said lien shall be added to said property owner's water and sanitary sewer bill, and failure to pay same shall subject the non-paying party to the billing penalty and discontinuation of service provisions of Sections 1046.35 and 1050.01.
