(a) No person shall permit the consumption of alcoholic liquor in any food service establishment within the Village, where the customer has brought the alcoholic liquor into the food service establishment, except as authorized by a license issued under this section (a "BYOB License").
(b) For the purpose of this section, a "full-service restaurant" is defined as a food service establishment, with interior seating at tables or booths for a minimum of twenty-five (25) customers, where food is ordered from a full menu and orders are taken directly from a customer's table by restaurant wait staff and served directly to a customer's table.
(c) A BYOB License shall entitle a full-service restaurant that does not sell alcoholic liquor, to permit consumption of beer or wine only brought onto the premises of the full-service restaurant by a customer that is twenty-one (21) years of age or older for personal consumption, including consumption by said customer's dining guests who are twenty-one (21) years of age or older, while the customer and dining guest(s) are being served a complete meal in the full-service restaurant, subject to the conditions in this section. The consumption of beer and wine is restricted to the licensed premises. The restaurant may charge a corkage fee to the customer. No more than one (1) seven hundred fifty (750) milliliter (ml) bottle of wine per customer or no more than thirty-six (36) ounces of beer per customer (unopened) shall be permitted to be brought into the licensed premises. The sale of beer, wine, spirits and all other types of alcoholic liquor to customers of the full-service restaurant shall be prohibited. No package sales shall be permitted. The sale of beer, wine, spirits or other alcoholic beverages (e.g., wine coolers, spirits, prepared mixed drinks, etc.) in single cans or bottles, kegs or pitchers or any other form is prohibited. Customers are prohibited from taking any opened alcoholic liquor outside of the licensed premises, except for a re-corked wine bottle that has been sealed in a carry-out bag in accordance with State law (235 ILCS 5/6-33). The licensee, on-site manager(s) and/or the licensee's wait staff shall be responsible for opening the beer or wine bottles or containers brought into the licensed premises by customers, and may provide glasses to customers as part of the service of beer or wine to the customers.
(d) BYOB License holders, their on-site managers and all wait staff engaged in the opening of beer or wine bottles under this section, shall take and successfully complete a Beverage Alcohol Sellers and Servers Education and Training (BASSET) Program that has been certified by the State of Illinois. A copy of the BASSET course completion certificate(s) for each such person shall be made available at all times at the licensed premises for inspection by the Village.
(e) Any person desiring to obtain a BYOB License under this section shall make written application for a BYOB License on forms provided by the Village.
(f) The fee for a BYOB License under this section is $75.00, per calendar year.
(g) There is currently one (1) BYOB License available in the Village.
(h) A BYOB License issued under this section may be suspended or revoked in the same manner as a food service establishment license.
