808.23 NUMBER OF LICENSES AUTHORIZED.
   (a)   The number of licenses authorized for issuance to persons for the sale of alcoholic liquor shall be limited as follows:
         Class A      Five (5) licenses;
         Class B      Three (3) licenses;
         Class C      Zero (0) licenses;
         Class D      Zero (0) licenses;
         Class E      Issued at the discretion of the Mayor, in his or her capacity as Local Liquor Control Commissioner;
         Class F      Two (2) licenses;
         Class G      One (1) license;
         Class G-VG      Zero (0) licenses.
   The Class references above correspond to the subsections in Section 808.06.

   (b)   Any license which is revoked or not issued shall automatically reduce the number of authorized licenses of the particular class by the total number of revoked or non-issued licenses in the particular class. In addition, the Local Liquor Control Commissioner shall notify, in writing, the Village Clerk and Council of any revocation or non-issuance of any authorized license within ten days of such occurrence, so that an appropriate ordinance, formally amending this section, can be prepared and approved by Council, to cause this section to accurately set forth the authorized number of licenses in each class.
   (c)   Any available license which is applied for by a license, authorized by adoption of an ordinance amending this section and issued, shall be used within thirty days of the date the license is authorized. In the event any license is not used within said thirty-day period, the number of licenses in the class in question shall automatically be reduced by one. In addition, the Local Liquor Control Commissioner shall notify, in writing, the Village Clerk and Council of the non-use of said license, within ten days of such occurrence, so that an appropriate ordinance, formally amending this section, can be prepared and approved by Council, to cause this section to accurately set forth the authorized number of licenses in each class.
   (d)   Any licensee who ceases to do business or closes said licensee's place of business for a period of more than forty-five successive days shall be subject to having his, her, their or its license declared forfeited and lapsed by order of the Local Liquor Control Commissioner. If any licensee desires to close the business or place of business for more than forty-five successive days, said licensee shall so notify the Local Liquor Control Commissioner in writing, including the reasons therefor, and request an extension. The Local Liquor Control Commissioner may grant such an extension on a showing of good cause. In addition, the Local Liquor Control Commissioner shall notify, in writing, the Village Clerk and Council of any cessation of business by a licensee, in excess of forty-five days (or such additional period of time as approved by the Local Liquor Control Commissioner), within ten days of such occurrence, so that an appropriate ordinance, formally amending this section, can be prepared and approved by Council, to cause this section to accurately set forth the authorized number of licenses in each class.
