676.10 CLEAN INDOOR AIR/SMOKING REGULATIONS.
   (a)   For the purposes of regulating clean indoor air and smoking in the Village, the provisions of the Smoke Free Illinois Act, 410 ILCS 82/1 et seq., as amended, and the regulations of the Illinois Department of Public Health, as amended, along with any applicable regulations under Federal law, shall be controlling, and are incorporated herein by reference thereto.
   (b)   Violations:
      (1)   Any person who violates the Smoke Free Illinois Act, as incorporated by reference in subsection (a) hereof, shall be fined pursuant to this section. Each day that a violation occurs shall constitute a separate and distinctive offense.
      (2)   Any person who smokes in an area where smoking is prohibited under the Smoke Free Illinois Act shall be fined in an amount that is not less than one hundred dollars ($100.00) and not more than two hundred fifty dollars ($250.00).
      (3)   Any person who owns, operates or otherwise controls a public place or place of employment that violates the Smoke Free Illinois Act shall be fined:
         A.   Not less than two hundred fifty dollars ($250.00) for the first violation;
         B.   Not less than five hundred dollars ($500.00) for the second violation within one year after the first violation; and
         C.   Not less than two thousand five hundred dollars ($2,500) for each additional violation within one year after the first violation.
      (4)   Any fine imposed under this section shall be allocated as follows:
         A.   One-half of the fine shall be distributed to the Illinois Department of Public Health; and
         B.   One-half of the fine shall be distributed to the Village.
