(a) Except as provided in subsections (b) and (c) below, the following limitations shall apply to the housing of equine animals on property zoned for residential purposes:
(1) The housing of equine animals on a parcel of property of less than 21,780 square feet (one-half acre) in area is prohibited.
(2) Up to two equine animals may be housed on a parcel of property of at least 21,780 square feet (one-half acre) in area, with one additional equine animal being allowed for each additional 10,890 square feet (one-quarter acre) in area above the initial 21,780 square feet (one-half acre).
(b) Where the housing of equine animals on property zoned for residential purposes is not in compliance with subsection (a) above on the effective date of this section (July 8, 2004), said non-compliance may continue, but may not be expanded (the total number of equine animals housed on the property may not be increased). The following parcel of property has been specifically identified by Village staff, as of the effective date of this section, as being non-compliant, and, as such, may continue to house the number of equine animals indicated even after the effective date of this section: 11500 West 123rd Street - three equine animals.
(c) In the case of the birth of an equine animal which causes a parcel of property to become non-compliant with subsection (a) above, the owner(s) and occupant(s) of said parcel of property shall have six months from the date of said birth to bring the parcel of property back into compliance with subsection (a).
(d) Excrement produced by equine animal(s) shall be removed from a parcel of property zoned for residential purposes, by the owner(s) or occupant(s) of said parcel of property, no less often than once per week (once every seven days), through the use of the Village's refuse hauler or by alternate refuse hauling means.
(e) Where a parcel of property has been granted a special use which allows for an equine animal stable, said parcel of property shall be exempt from the provisions of this section.
