422.04 ISSUANCE OF CITATIONS.
   The following procedure shall govern the issuance of citations (P-tickets) in certain cases as set forth in this section:
   (a)   Use of Illinois Vehicle Code Section Numbers. In lieu of using any section, or in addition to using any section, of this Traffic Code, the officer issuing a citation may issue it by using any of the sections of the Illinois Vehicle Code, as enumerated below in subsection (b) hereof. Every numbered section in the Illinois Vehicle Code shall be referred to by the letters "PP" prefixing the section number. All citations so issued shall be issued in the name of the Village and referred to in the citation as an ordinance violation. Penalties for violations set forth in subsection (b) hereof shall apply to such violations.
   (b)   Procedures.
      (1)   Applicable sections. Whenever a police officer is authorized to arrest a person without a warrant because of a violation of any section or provision of the following sections, said police officer may, in the first instance, in lieu of filing a complaint in court, issue to such alleged violator a citation (P-ticket) and:
         A.   Advise said violators that they have violated a specific ordinance or IVC section;
         B.   Advise them that they can make payment in the amount set forth below, in settlement of said violation claim; and
         C.   Inform said violators that upon failure to so settle, a complaint may be filed in the Circuit Court of Cook County charging them with such violation, or that the citation may be referred to a collection agency, as authorized by the Village and permitted by law.
      Nothing in this section shall preclude an alleged violator from requesting a court appearance for the judicial adjudication of the charge. In such cases, a uniform traffic ticket shall be issued in lieu of a P-ticket.

      (2)   Payment and settlement. Pursuant to said citation, the person so accused of said violation may settle the claim by paying the Municipality the applicable amount as shown in the schedule set forth above, within a period to be specified in said citation, not more than fourteen days nor less than ten days from the time the alleged offense was committed.
   Such payment shall be made in accordance with the instructions in the aforesaid citation at the office of the Police Department, which shall issue a receipt of the money so received and promptly remit said amount to the Village Treasurer to be credited to the proper Municipal fund. All payments shall be made to the Village. Any cash payment shall be made only at the Police Department or Village Hall, and a Village receipt shall be given for all amounts so paid.
      (3)   Final notice. In the event that the person to whom said citation is issued fails to settle and pay said fine in the time specified in the citation, a final notice shall be mailed to him or her. When in fact the final notice has been mailed, the violation may be settled by paying two times the amount set forth on the citation, within the time specified in the final notice.
      (4)   Issuance of complaint. In the event that the person to whom the citation is issued fails to settle and pay said violation claim within the time specified in the final notice (if one is served or mailed to such person), then the police officer is authorized to cause the citation (Notice to Appear - P-ticket) to be served upon said alleged violator and is authorized to file the same as a complaint in the Circuit Court of Cook County and prosecute the same, or the police officer may refer the citation to a collection agency. The officer, as an alternative, may file a formal complaint in the Circuit Court of Cook County in lieu of the citation in accordance with Departmental procedures.
      (5)   Form of notice. In the event that the violator fails to pay the fine in accordance with the citation, the Village shall issue a notice in essentially the following format:

      (6)   Correction of violations. The payment of an amount as settlement, as provided herein, will not excuse the correction of the violation.
      (7)   Responsibility for parking violations. The fact that an automobile or motor vehicle which is illegally operated or parked is registered with the Secretary of State in the name of the alleged violator, or the fact that a vehicle sticker issued by a municipality has been issued in the name of and to such alleged violator, shall be proof that such alleged violator was in control of or was the operator of the automobile or motor vehicle at the time of such alleged violation.
   The commercial lessor of any vehicle, whether or not he or she is the registered owner thereof, shall be responsible for such parking violation and shall be subject to the penalty therefor.
